Reception child on verge of being suspended, help please!

Hi,

Sorry if this doesn't sound very coherent but my head is all over the show

For context, my DS started reception in September, a year later then planned as he has developmental delays and learning difficulties

Upon starting school, I approached the Sendco on the advice of the peadeatrican and essentially the school weren't interested

Fast forward to now, a number of incidents later which his teacher says "just kids being kids ' including today's latest incident being horrible to another child about their skin colour and have received a phone call from the head teacher advising he is on the verge of being suspended

I have 2 older dc at the same school as well and having never been in this position before, I have no clue what to do or what my rights/schools rights are , is there anyone else who has experienced similar or can offer any advice ?

Sorry about that @Georgesdinosaur89, I’m back now.

Do you want to tell us a bit more about how delays and what support he’s getting?

For instance if his speech is delayed, has he had a hearing test and is he currently receiving SaLT?

Does he have an ECHP and is he in a Special School or mainstream? If he’s in mainstream does he have a TA?

And has he had an assessment by an OT?

Request a meeting with the SENCO again. The school must make their best endeavours to meet DS’s SEN and they must make reasonable adjustments. That isn’t optional. Have they provided any support? If they are on the verge of suspending, they should have already put support in place. Don’t worry if they do suspend, but make sure it is formal. A suspension will a) provide you with evidence of unmet needs, b) force the school to follow due process, c) limit the number of days the school can suspend for, d) allow you to challenge any suspension, and e) ensure he receives alternative provision if he reaches that threshold.

Alongside this, request an EHCNA yourself. IPSEA has a model letter you can use.

Other than the paed, are there any other services involved?
