to get shouty if they refuse to refund me?

Long story I'm afraid but I'm stressed and pregnant and tired and fraught!

Our car broke down, and because it has a lot of things going wrong with it we were undecided whether to scrap it or repair it. So we had it transported to a dealership an hour away because our local garage couldn't fix it, and the dealer advised that they could use their computer to diagnose the problem. The dealer phoned to say they'd diagnosed the problem, and quoted a price for the repair. We gave it some thought and decided that on balance we'd be as well to fix the car up and run it a bit longer, so we asked them to go ahead.

I went to collect it yesterday, paid my several-hundred-pound bill and then discovered it wouldn't even start! One of the technicians came out and fiddled with some fuses and said he thinks the whole onboard computer is on the blink, and said it might run for a bit before dying and showed me how to reset the computer if it won't start. I wasn't exactly delighted about this but I had no choice but to take the car away - I had an appointment to get to, a 2 year old with me and my lift was one way only.

Anyway, the car got me nearly home and then when I stopped for shopping it wouldn't start. I phoned the dealership, in tears by now, and a nice man came all the way out with his computer to try and get it started for me so I could get it to the house, but basically it's no use because it might or might not start next time I go anywhere. The costly repair hasn't fixed anything.

They say the part, once fitted, is no use in another vehicle, so although they're going to be calling me today the guy thinks it's unlikely they can refund me. But nobody told us until after I'd paid and gone to collect it that the whole system could be flawed and the repair they did wasn't necessarily going to fix it. If they'd told us this beforehand we would never have gone ahead with the repairs, the car just isn't worth it (and to renew the onboard computer it's likely to be another £1000 or so, which is about as much as I could consider spending on another car, and more than mine is worth ).

I'm not in the wrong to argue for a refund of the parts and labour, am I? Obviously we're totally happy to pay for the transport and diagnostics, but I really feel ripped off, at best by a communication breakdown, at worst by really unscrupulous practices. And I've got a whole lot less cash to spend on another car now I've paid for this sodding useless part. It was savings for my maternity leave, too

If they cant get the money back and its a small dealership I don't like your chanches= however- how abot you ask for the difference off your next car if you buy it from them or suggest you meet in the middle- get half a refund?

They are being VU. If you paid for a repair which they said could be completed satisfactorily, they cannot then cop out after they have taken your money. Trading Standards should be able to help further- see this Don't give up, your are in the right here.

They're a big dealer MrsVidic, they hold the brand franchise for the whole of the region. I think it's unlikely that they stock cars within our price range and to be honest I am really disillusioned with this manufacturer - although it's a fair suggestion so I'll bear it in mind.

I can't afford not to argue this one with them though, and I really feel like I've been done.

Can I suggest you give trading standards a call? I've had a horrible situation lately and despite the company being dead set against helping me, once I started quoting the sale of goods act 1979 (covering goods not of satisfactory quality) they did an amazing 180.

Needless to say there was no phonecall. It's a well known French brand. I shall update later when I've chased the robbing gits customer services up.

I phoned today. It's complicated but they think another part worth £120 might fix it. If it doesn't, they won't charge us the £120. If it does, we pay for it. In the meantime (it takes ten days) they'll give us a courtesy car. But no dice with a refund.

DP thinks we accept it. I'm tempted to hold out for a refund for the part but it leaves us with no car and a tiny budget to replace the car.

Did you pay by credit card ? They will often fight your case for you, even if you pay 99% by cash/debit card i always put anything over £100 on the credit card and clear it straight away to give you some protection.
Good luck, I hate cars, know nothing about them and constantly feel ripped off

Wish I had slapped it on a card now, but never mind. They've been quite generous with the repair offer - we'll be a bit more out of pocket if it gets fixed, but much less than a new car, and they're going to collect it, deliver the courtesy car and do a pre-MOT check for us before they do anything else, in case it's totally buggered. If it doesn't get fixed we'll be no worse off than we are now.

Can't grumble too much, and they were much more accommodating than I'd expected from previous experience with another branch. I think me being pregnant and weeping and generally devastated is quite frightening for blokey car types!
