I have an 07 Espace. When it got fixed last March the dealer reset my 'service due' button, which meant my reminder of 12,000/annual service reminder did not come on. This service would have told me a % wear on my brakes. The brakes have now worn down to the dics...which is much more money. Am I unreasonable to expect the dealer to foot the bill?

Har far past 12,000 miles are you?

OldLadyKnowsNothing · 01/03/2010 13:19

How far.

posieparker · 01/03/2010 13:20

No idea, probably not much, because of my all singing all dancing dash I have no idea. I just waited for the warning light.

Posie did you work everything out with your husband? I was thinking about you this weekend.

Hope you're feeling better.

suitejudyblue · 01/03/2010 13:23

Its really annoying and you could try asking the garage but I suspect they won't be having any of it. Its really your responsibility to keep a check on the service interval.
Has the car only done 12,000 miles or is it 12,000 from the last service ? If its the former I'd be asking why the discs have worn out so quickly.

southeastastra · 01/03/2010 13:23

couldn't you tell they were worn? i don't think they should pay, you shouldn't really rely on the warning lights

paisleyleaf · 01/03/2010 13:25

Have they worn to the discs within a year?
It'd be interesting if you did get it free, as I'd be surprised if you did.
Do people really depend on a warning light/postal reminder when services and MOTs etc are due?

posieparker · 01/03/2010 13:28

How would I tell they were worn? I noticed today because the metal was scraping the discs.

I have no idea about the mileage, I bought a new car so I didn't have to thinkm about these things.

SK, weekend was tricky, old stuff came out...I caught him out by emailing someone from his email and she confirmed something he's denied for ten years.

yabu

your car, your resposibility

itsmeitsmeolord · 01/03/2010 13:30

Its your car, your responsibility.
Stating you bought a new car so you wouldn't have to worry about these things is a bit pointless.

The garage shouldn't pay.

itsmeitsmeolord · 01/03/2010 13:31

lol at cross post, great minds ....

ShowOfHands · 01/03/2010 13:32

It's frustrating and damn annoying but I don't think any amount of warning lights or lack of them absolves you from the personal responsibility of ensuring your vehicle is roadworthy.

You can but ask I suppose.

lol you really think they should pay

I can't beleive anyone would wait for a light to tell them when to sort stuff with the car

also even if the light was going to go on at 12 miles, how do you know the brakes wouldn't have worn out beofre then

ReneRusso · 01/03/2010 13:34

They made a mistake and so they should probably meet you somewhere half way on the bill. You probably can't expect them to pay all of it.

TrinityIsFuckingTrying · 01/03/2010 13:35

oops sorry I just saw that the service would show you a % of brake wear

so my last point is moot

but still

they are not going to pay

TulipsInTheRain · 01/03/2010 13:37

for gods sake....

if your boiler broke would you ignore it 'because it wasn't due it's service yet'

if your pc crashed would you give out to the manufacturer 'because no warning message came up'

don't be so silly and stop trying to blame the mechanic.

brake discs that badly worn you would have been able to feel while driving, and if you've been regularily servicing it every 12,000 miles it's hardly difficult to check your milage if you think you might be due one and check if it's close to a miltiple of 12,000 is it?

TrinityIsFuckingTrying · 01/03/2010 13:40

yes I also think its strange that you are 'suddenly' on metal

you can feel them getting really bad and have time to sort them before they are on metal

JaneS · 01/03/2010 13:43

Most cars come with instructions to service at x miles or x years - the implication being that the number is a bit of a best guess. You should know better than to trust a warning light.

BelleDameSansMerci · 01/03/2010 13:52

Also, while the garage would probably have advised you at the time of getting the car serviced that you needed new pad/disks it wouldn't form part of the service. You'd still have had to pay for them when they needed to be renewed.

Honestly can't see the garage feeling they are responsible in any way for this.

posieparker · 01/03/2010 14:05

The service would have given the indication that the pads were worn...which is a pre warning to the damage and further expense when brakes are so worn that they scrape the discs.

When we purchased the car we weren't told about annual service, just the number of miles. The annual service is in May and the car told us....and we got it serviced.

The garage, according to Trading Standards, should have warned us that they had reset service lights and have some responsibility for the repair of the discs.

OP posts:
TrinityIsFuckingTrying · 01/03/2010 14:15

they probably should have warned you about reseting the service light

but really I dont think you should press it

you can tell your brakes are wearing from driving the car

service lights, yearly services etc pft

just feel the car, think about how long since stuff was done

take responsibility for your car

I'm sorry but I actually think it's quite funny that you have even looked into trading standards about it

Interesting that you say that Trading Standards say they should have told you. If that is the case then I would definitely try and get them to pay. Do you know what leglisation that was under, I had the opposite experience once when my indicator wasn't reset but didn't know they were obliged to do anything.

posieparker · 01/03/2010 14:40

Supply of goods and services Act 1982

Trading standards say I should take a letter with me tomorrow, they may do nothing but it is a first step if I wanted to take them to court....which I wouldn't.
