in not letting big store know that package has arrived?

More of a WWYD than AIBU, really, but I would really like some opinions. I ordered a very pretty and fairly expensive set of lingerie on Feb 1st online from a big store to surprise DH on V-day. We've had a rough few years and its only very recently that things have got back on track.

Anyway the lingerie never arrived, and I was very let down. I know this sounds sad and terrible, but it ended up ruining my day and my surprise for DH.

I called the store the next day and complained and they refunded the money, including the postage, which was nice of them. However the stuff has arrived today, and it looks like it was the courier's fault and not the store's. I am still disappointed about my ruined V-day and very very tempted to not let the store know that the lingerie's arrived and just keep it. AIBU? WWYD?

You must tell them, as it is their responsibility that the lingerie didn't arrive - they chose the courier company - and they need to ensure that they sort their logistics outsourcing so that other customers aren't disappointed in future.

I'm sure you'll still get to keep the lingerie - after all, your Valentine's Day surprise was still ruined through no fault of your own and you deserve compensation.

And the Dempsey and Makepeace book I stole when I was 13 . I recently binned it and bought another copy at great expense (as it's so old and out of print) because I couldn't bear looking at the tainted one

Well given that they've said they won't refund lingerie, I would absolutely refuse to pay for it. It should be up to the courier to compensate.

Grits teeth whilst waiting around for HDNL to redeliver package from Amazon that they took to the wrong address yesterday Why doesn't anyone use Royal Mail any more?

I'm glad that you phoned and told them it had arrived - if it was the depot's fault rather than the driver, he could have gotten into alot of trouble and possibly even lost his job as they might have assumed he had stolen it.

I agree if they wont let you return it, they should let you keep at at no cost.

givecarrotsachance · 24/02/2010 12:46

There must be some confusion at the store end - the person you spoke to is nuts to say you can't return it given the circumstances - and given that they've refunded it it's in their interest to either have it back or be lovely customer service people and say you can keep it.

I wouldn't personally have said I wanted to return it, but asked "what should I do".

FYI with a mail order delivery you have the right to return it within 14 days anyway, and even though it's lingerie this should still apply. This doesn't apply here as they've refunded you, but it's worth knowing about.

At this point, you've told them, it's their problem now. It's absolutely right to tell them and I would strongly agree with the other posters who said this, but it's now up to them. Don't sweat it.

Please let us know what they say when they get back to you!

mrspoppins · 24/02/2010 21:31

be honest.

mrspoppins · 24/02/2010 21:33

Just seen you were...good girl! [gives a sticker emoticon...sorry it's all I know!!!]

tweetymum · 25/02/2010 05:10

Lol, mrspoppins!

Well, I got the call this afternoon, and they've let me keep it, yay!! Apparently they have to take it back even if its lingerie (as givecarrotsachance said) but in this case they won't bother as they don't know if I've used it or not and it was so late and they had already refunded. Also, they have to refund the additional return delivery as well.

Glad I chose the good way []

Myhermes are a bit shite. They are v v cheap but take about a year to deliver anything at all, tracking is useless, honestly...can't believe big stores use them.

Mind you M&S use royal mail without tracking for some stuff...they sent a parcel worth £65 to my old address once and had zero idea where it was. I'm nEVER using them again.

kitcat1977 · 25/02/2010 09:42

I'm not using Amazon until they stop using HDNL. I'd much prefer Royal Mail.

runnybottom · 25/02/2010 09:44

Legally you have no obligation to do anything at this point, they have to arrange to collect it from you if they want it back. They cannot charge you, they cannot demand you send it back to them. You can leave it back where the courier left it, unsigned for.

If they have any sense at all they will tell you to keep it, if they don't, let them sort out how they will get it back.
