seller is refusing to give me a refund

until i remove the feedback i left!

Ordered something online, didnt arrive on time, so returned it and asked for a refund. 36 days later i am still waiting for a refund.

On day 32, i left feedback stating, 'despite returning the item, i am still waiting for a refund' (I have emailed him numerous times and have been given various excuses)

Seller has just emailed me to say he will not refund me until i remove my feedback.

Would you remove the feedback or tell him to sod off?

Depends how much you want the refund - you might find that you remove the negative rating and the seller still does not refund the money. If he has taken this long to refund your money (and I note you gave him a month before you left feedback, I suspect you probably won't see the refund even if you removed it) If the amount is relatively small, annoying though it is - I think I would be happy to leave negative feed back (and perhaps even add to it his latest requet) and have no refund, rather than remove comment and still have no feedback.

Can you not contact a customer service section re this - I didn't think sellers were allowed to ask you to change feedback (and certainly not withhold a refund until you did)?

did you pay via paypall? get them involved or just get e-bay involved (assuming its e-bay), can you remove feedback, get a refund then, re-post feedback?

Shophappy, the refund is for around £50+, paid with card on Amazon. I have complained to Amazon and it takes a good few days for them to reply. I have pointed out to him that he cant do this, quoted the distance selling reg and office of fair trading, but he doesnt seem to care and just keeps repeating himself.

Addict, i thought that too! cant decide whether to be cunning or a woman of principles and stand my ground!

Remove the feedback.
Get the refund.
Post new feedback including his illegal manipuation of you post-sale.

He won't do it again!

Try phoning Amazon customer services for a faster response: 0800 4961081 or 0208 636 9451. And keep contemporaneous notes of your conversation in case of any later dispute.

My concern is that Claw3 will remove the feedback, and still not get the refund - I would perhaps play his game - remove feedback - say he has 5 days to produce refund, otherwise you will repost not only the feedback comment but also his threats regarding giving the refund. (And if I was you , given all his game playing, I would do it anyway even if you get a refund (if you want to soften things, you could state that you did eventually get a refund but only because you withdrew feedback)

Justagirl, thanks for that just phoned Amazon, they were very helpful and told me not to worry as they will refund the money and to leave the seller to them.

That is shocking claw3. Really glad you got a result from Amazon. I'd still add the rest of the story (about them trying to bully you etc) to the feedback! But then I'm a meanie who has had a rubbish day

Actually, if this was on Ebay (where i have bought things loads of times) then he doesn't HAVE to give you a refund if he was a private seller.

If it didn't arrive in time then it is not necessarily the sellers fault. He may of sent it in time and it just got stuck in the ROyal Mail system. You should have asked for proof of postage within 7 days of buying (as per Ebay rules) and if not forthcoming then you should have filed a paypal dispute.

You would be asked to return it tracked at your expense to receive a refund.

Did you track it's return? If not then how do you know it hasn't got lost in the post somewhere?

I think YABU as feedback should never be left until a transaction is totally complete. In which case it would be once the seller had confirmed receipt of the returned item via tracked post or that paypal said you were not entitled to a refund as he had posted within the required time to you.

Hando, private sellers HAVE to give you a refund unconditionally, you can cancel the order at anytime after placing it and up to 7 days after receiving it.

Its the LAW, whether you shop on e-bay or anywhere else on the internet. Your rights are different when you shop online and are covered by the distance selling regs.

The transaction was complete, i cancelled my contract with them 32 days previously.

Great news! Amazon are fab - I changed my mind about a dvd (totally my fault, nothing wrong with it) then forgot to send it back for months. Got my refund through today - they waived the time limit.

Hooray all round
