AIBU about my ex employer.

I applied for a great job, passed the assessments and tests, attended 2 interviews and was delighted to be given a provisional job offer - subject to satisfactory references and crb.

Crb and 1st ref came back great (they read me the reference over the phone), my 2nd to last employer said great things about me. My last employer's reference has given them cause to call me today and tell me that I am no longer being offered the job, but that I can appeal this.

The HR assistant (at the potential new company) read me out the list my ex employer had given them in the section they were asked to complete about any sickness absence I've had in the last 3 years. I haven't had alot but took 2 weeks parental leave last year when my dd was ill. They have not only put this down as my sick leave, but have also said it was because my daughter was sick. On the other occasion I had 1 week sick leave they have written what was wrong with me - ie. the medical condition I was off sick with.

I hadn't told the new company I had a daughter, and I'm annoyed that they have now been told this by ex employer without my permission. I also thing they shouldn't be able to detail the reasons I was off sick giving details of my medical condition. It wasn't too personal, but could have been and I can't see it being relevent for one occasion of sicknes. Plus I do not think the new company should be allowed to count parental leave as sick leave. They have an acceptable number of sick days they would like thier new employees to have had and if it'smore than that then they wil not employ you. This parental leave has put me over this "allowance".

Perhaps I'm just pissed that I now probably won't get this job.

Just came back on to update after all your helpfulness. I spoke to the HR manager at "new job" today and she has agreed that the reference they gave wasn't 100% and included some info they shouldn't have and said that she is happy to continue with my offer of employment. Whoop!

I had asked her to give me a copy of the reference they sent, but as I now have the outcome I wanted I can't be arsed to moan/stress/complain to ex employer, it's too near Xmas and I'm too excited about new job.

for the record... a company cannot give a bad reference as implied by stillsquiffy. They CAN refuse to give you a reference, which obviously does not look good to a potential employer of yours, but they CANNOT give you a bad reference.

Also, the can't disclose WHAT you were off sick with. They can only give the time that you took off sick. Even a doctor can't disclose that info without your permission!!!

And, parental leave is TOTALLY separate from sick leave. It is the company's discretion as to whether their policy is to grant parental leave for a said amount of time. But, they would have had to agree it! So they can't use that against you because THEY AGREED it on that term.

I know its been some time since you posted this original thread but I hope it all worked out for you in the end x

Again, I've been looking through posts to see if anyone has had the same issues as me. I brought it back up again incase anyone since them has had a similar prob and might have found it interesting. I've my own issues at work at the moment and am trying to gather bits of info up whilst adding my own facts that I have found out to it.

Didn't really see the harm in that but if its p*ing people off... which is unintentional... then I suggest you just don't read it again.
