Actually, I'm pretty sure I'm not, but I need a rant!

I ordered DS's christmas present to be delivered to his Granddad's house where we're spending Christmas because they offered a "named day" delivery service - now they refuse to do this, but say that they won't refund either. My dad can't sit in the house between now and Christmas on the off chance their delivery finally shows up (he spent all day Sat waiting in for the original date, then all day today having been told it was today, and it's only just now they've 'fessed up and admitted that there is no such thing as a definite delivery date). No-one in the family has a car, so if we miss the delivery we can't go to collect it from a depot. I've explained that I only placed the order because they offered this delivery service, but they say they can't offer a refund. So it looks like we won't get the present (my dad has to go to work) and they won't give a refund.

Grrr.

Does anyone know the legal situation on this?

Well I have had an excellent experience recently - I went into town especially to buy my sons new shoes on Sun and only realised when we got homw that despite having his feet measured i had been given the wrong size shoes (the same size as the ones I was replacing). I emailed the store to complain and they have arranged to come to my house in person on Friday with the new shoes and to take the wrong ones away!

OK so they haven't been yet but I am impressed with that! This was all dealt with through their store though, not online.

And to the OP - by the distance selling regulations you are entitled to cancel an item up to 7 days following when you receive it (so you are clearly within this timeframe as you are yet to receive it) and that unless you are told at the time of taking out the contract (so buying it) otherwise the seller has to arrange for collection of the item at their expense. I would look up the specific wording of these regulations online before phoning back and quoting it at them verbatim before requesting a refund! It doesn't apply to certain things but the duplo you have ordered will def be covered. Good luck!

i studied the sale of goods act a long time ago - they sound like they are in breach of this - if they said it was named day delivery as part of what they were offering you - ie before you paid the money. They should therefore give you a refund - doesn't sound as if this will help you much though. might be an idea to say that you've been seeking help on mumsnet and you have loads of people awaiting the outcome? Or is that against the rules???

Update from me - my stuff has arrived just in the nick of time, and I noticed that the packaging says "next day" on it, so it looks at least as if they were trying . . .

Might give them another chance

Phew, crisis over. The duplo arrived today, fortunately late on after my dad had got back from work. So Santa will have arrived on time Apparently the delivery note inside did say "Saturday delivery". Will be a bit wary in future, but at least it's all ok now.
