Have had my mobile phone contract with CPW for 5 and a half years, contract about to run out so rang up last week to cancel as i have seen a better deal on the net, the deal was for 100 mins and unlimited texts for £15 a month with 14 months free line rental

CPW said we can match that for you, give you same phone for £15 a month but instead of 14 months free, i would get £200 cash back! she also said i could have a bolt on for unlimited internet.

I said great i will go for it, however the phone came and the battery life is shit, i got the phone on Tues and already had to charge it twice, so i rang to tell them i would like to swap it.

I since found out that the deal they have given me is actually for 75 mins and 250 texts this is not what she told me on the phone

So i have asked them to investigate the phone call and either give me the origonal deal or cancel my contract, they were very reluctant to do this and said they will give me another deal for 200 min but i can't have the bolt on and i cant swap the phone for a different make, i have to swap it for the same make, which is shit because the battery life is shit

AIBU to tell then to esculate my complaint so i can cancel my contract with them? or should i just keep 75 min and 250 text and swap the phone in the hope i just got a dud battery with this one?

Wannabe thats what i told them on the phone, i said i was more bothered about being miss infomed, than i was about the faulty phone, but the guy on the other end just kept going on about how i dont really use that many texts so why would i want unlimited texts anyway? i fell like screaming 'thats not the point! you told me lies grrrr'

I had a major battle with CPW about a year ago. They rang me one evening while DS2 was yelling his head off with some deal. I said it sounded reasonable, but wouldn't agree to anything without seeing it on paper (I am a lawyer). Then I forgot all about it.

3 months later I got £100 cheque which reminded me about the conversation. Still no contract. I rang, complained, rang again...they found the recording of teh conversation and eventually cancelled teh contract (which was a rubbish deal).

complain but it may turn into a battle. their default is No, no then no again.

I have an LG Cookie phone, bought it a month ago and have only had to charge it 3 - 4 times, so it may just be that you've got a dud battery.

Certainly think that YANBU to escalate it though, if they made that offer then they should have to stand by it or let you out of the entire deal, they can't just rope you in with one offer then insist you live with an entirely different offer for 2 years.

If they won't be reasonable then copy in the appropriate ombudsman in your next letter / email. We had problems with British Gas a few years ago and after speaking to them a dozen or so times as the problem recurred every month I emailed the relevant ombudsman and copied in British Gas, instant resolved the problem, it was miraculous.

I feel really bad now
DH has assured me the battery life is fine and his phone needs about the same charging (diferent make).
TBH I usually ignore my phone in the bottom of my bag for days on end so by the time I get it out it always needs charging, it took a while for me to realise it seemed to need doing more than my last one.

The guy on the phone was getting really shirty with me, but i stayed calm and just kept repeating, 'can you please investigate the phone call which states my origional offer'

The he started raising his voice to me saying, 'but you dont use the internet, so you dont need the bolt on, i will give 200 mins, why wont you just accept that, its a better deal!' so i pointed out that i didnt use the interent with my previuos phone because it was not suitable for viewing web pages, and could he please just esculate my complaint, he was not very happy

I have the LG Cookie and i find that my battery life lasts almost a week, and thats with it turned on all the time.
I think you may have got a bad one, but i would most certainly complain about the tariff being incorrect.

Make them give you what they said they would, or else let you leave with no financial penalties. Make it very clear that these are the only two options.

Very cheeky for them to say 'you don't need that anyway'.

Complain escalate and complain again.

I always hated CPW and couldn't wait for my 18-month contract to be up, but then got a fantastic deal from them this summer (sorry - don't want to rub salt in your wounds and what-not).

I did make sure I took his name, noted times of calls but needn't have worried as he gave me his direct line number and email address (!). Before I agreed to anything I rang him again to confirm then emailed him to put it in writing. He did, very promptly so my faith has been restored.

You really should have a cooling off period though shouldn't you?

i had a very similar prob wih carphone, however i had a branch i could go intot o cause a fuss!...they completely mis sold me the contract and eventually (within 14 days) accepted they had and agreed to take phone back and cancel...they didnt!..cancel it that is..that was march and only last week did i FINALLY receive the FULL amount of 18 months line rental from them which orange had now passed onto bayliffs!!!!!!!!!!!!!!!!!!!!!!!!

ring trading standards, log exactly what you were told, what you got, what theyve now said, theyll tell you to put this in writing to car phone whorehouse and await a reply..send everything recorded, keep copies of everything you send, log times/dates / names of phone calls and PESTER them, no need to be nice, they ONLY understand facts and figures, dont back down, you WERE mis sold the contract, they do it ALL the time to get the commision (that they also deny getting but i know they do!) and are the most underhand company ive EVER come across, good luck!
