To think there should be tough punishments for people who ignore county court judgements

My brother is an electrician. He did thousand of pounds of work on customer's house. The woman has not paid him a penny. He spent a lot of money taking her to court and won his court case. He is finding next to impossible to enforce the court ruling as he cannot afford the cost of baliefs. He is close to bankrupty himself.

I feel there should be tougher penalties for people who ignore county court judgements. There is no excuse, even if you are benefits and have kids. You should at least make an effort to pay something. Or they should learn to live within their means and not pay for housing improvements they can't afford.

Prehaps if people who ignored county court judgments were sent to jail then the court system would be fairer.

People get sent to jail for shoplifting and why is refusing to pay an honest tradesman any different.

i want to go on holiday with you!

expatinscotland · 21/08/2008 20:53

no, he's not due to almost Halloween. he still needs to cook a bit.

and yes, i am putting off swallowing my second dose of Floradix of the day because a) it tastes minging b) even that upsets my stomach and i have to eat a clementine with it which sucks as i have wretched heartburn.

lardybump · 21/08/2008 20:54

So do I wow that is very impressive.

FAQ · 21/08/2008 20:54

you need to go with ShelleyLou - the 5 bottles of wine would never have happen if she hadn't made friends with one of the barmen at the park club - should have been 2 glasses of wine get the bottle free - she was getting that - but for the price of one glass

expatinscotland · 21/08/2008 20:55

sounds like my kind of holiday, FAQ!

whenever we go, we go self-catering cottage or caravan.

kiddy stuff by day, party by night.

the best EVER was when we took my folks.

that so rocked! 5 bed house, nighttime babysitting on tap, 3 pubs in walking distance.

bliss!

theSuburbanDryad · 21/08/2008 20:55

Ah - thought you were due at the same time as Franny

Heartburn sucks ass. I got it really bad with ds - drank gallons and gallons of milk which was the only thing that sorted it, and put on 4 stone!

Oh expat congratulations, not long now... I still have to wait until Feb.. I am praying my iron levels are ok with this one....

theSuburbanDryad · 21/08/2008 20:57

lardy - i'm due in Feb too!

expatinscotland · 21/08/2008 20:58

mine are mildly anaemic - just around 10.

and i want to keep it that way.

last time, they went down the pan, vascillated between 4-6 and i felt like utter hell.

i simply cannot take iron tabs as they rip my gut up to the point where i can't function.

i think i heard somewhere that Guinness is good for iron levels .

lardybump · 21/08/2008 20:58

Hay snap congratulations SD...

UniversallyChallenged · 21/08/2008 20:59

YANBU - same thing happened to my sister. Single mum working hard to get a car and bought one from someone who it turned out sold clocked cars. She traced him took him to court and twice he turned up, said he would pay her the car price back in front of the judge.....zilch.

She's down about £1k poor thing. Yet he gets away scott free. Sickening

I went to the south coast with DD for just over a week to stay with my bro and SIL, a few other family also came down from up north, other family joined us its was fab. In a way better than going abroad just me and DD which is what we usually do.

The weather could have been better but got a bit of colour.

KatieDD · 21/08/2008 21:00

Lardybump - I quote "The woman knows that she owes the money. Its not a silly mistake. She has been taken to court and she knows she owes money. The judge set out terms for her to pay so much a week of the money owing. She has refused to pay a penny and ignored the court."
I am well aware of the difference between the ability to pay, a CCJ and just plain refusal - THAT should be contempt of court.
TheSuburbanDryad - I have previously worked in collections, I simply couldn't work in that environment any more because I'd be the one in Jail for throttling somebody.

Remotew · 21/08/2008 21:03

Sorry katieDD, thread went all over the place, will leave you to discuss the point you want to make.

theSuburbanDryad · 21/08/2008 21:03

We've moved on Katie. Come and talk about cheap boozy holidays and heartburn cures!

KatieDD · 21/08/2008 21:05

We all find our own level theSuburbanDryad

lardybump · 21/08/2008 21:06

AGAIN Katie the judge would not set out terms for her to pay when issuing a CCJ. She may not have even been there in which case could not be held in contempt. A judge will only set out terms to pay if the creditor enforces the CCJ. As the OP clearly says her brother has not enforces the CCJ so then the judge would not have set out terms to pay.... THe courts have issued a judgement which is a legal acknoledgement that the debt exists.

lardybump · 21/08/2008 21:09

Mind you last time I had a boozy holiday was 9 months before dd was born so maybe its a good idea I stay dry for a while....

KatieDD · 21/08/2008 21:23

FFS - THE JUDGE DID LAY OUT THE TERMS "The judge set out terms for her to pay so much a week of the money owing. She has refused to pay a penny and ignored the court."

lardybump · 21/08/2008 21:26

SD I am getting really bad Heartburn and was told that milk makes it worse!!! So should I be drinking gallons of it then?

expatinscotland · 21/08/2008 21:29

Ranitidine and Gaviscon Advance here.

The shit part is that I have to up my Vit C intake to absorb the iron better to try to combat anaemia, but acetic acid (Vit C) just increases my heartburn.

Arrrggggh.
