so therefore do not have to accept terms and conditions that allow companies to abuse their customers whose money they have taken in good fath in return for goods/services etc.

if terms of a contract are grossly unfair, i.e an unconcscionable bargain where one side has abused their power, then the contract is not enforceable. but if it is a legal contract then you are bound by it..

so, no we don;t live in a fascist state, but we do have laws of contract.

if you have been ripped off etc then complain to the relevant ombudsman or trading standards watchdog

Are terms and conditions drawn up by lawyers?

well, it depends really. what the goods were, who you bought it off. many companies use standard terms and conditions, but you are supposed to read them and the small print befor you sign
some small businesses may use pro forma contracts rather than specialist ones.
sounds like you have a particular scenario in mind? you might get more responses in the legal/ money matters section if yuo have a query about a contract

Thanks - I will.

If this is in relation to the bed, i am amazed that their internet terms and conditions can override the law - which is that once they've taken your money, a contract has been made. But I'm not a lawyer. You could call watchdog or that Dominik Diamond programme maybe??
