AIBU to suspect my DH had an affair and gave me herpes?

NC as it’s humiliating if what I am thinking is true.

Early last summer, a close friend of DH passed away. DH went to the funeral and he said that the other close friends were also rallying around the widow to help her through the grief. I think you already know where this is going….

We had just relocated to France, so this involved travel for him back to the UK for the funeral and two other times, I was supportive as the widow isn’t English and her husband’s family were treating her horribly- trying to throw her out of her home, or that is what DH told me. So he and others were helping her relocate to London.

In September, DH went back to UK at the start of term to help one of our DC collect items from storage and move to their new student digs. The night before his flight from London back to France he said DC was all settled, he was going to check into the London hotel and go have a tea with the widow to see how she was getting on. This turned into dinner as well.

He comes back to France. Then we have sex which was very painful and I bled. I have been having difficulties in that department due to menopause vaginal atrophy as well as extreme fatigue from having cancer.

The next morning I have unusual watery discharge with the usual bleeding and pain. I think it is yet another allergic reaction to yet another prescription for intimacy. So I start on antihistamines. Five days later, blisters start to appear. I book in an urgent appt with my gyne, who sees me 3 days after I called. One look, and I get told it’s likely genital herpes. I sit there blinking and shocked.

I am sent off for an STI test.

I had been married for 31 years at that point. And yes, never once cheated or fooled around. I did get HPV from a rapist. DH is only man I have ever slept with consensually my entire life.

I ask my DH how in the hell did I likely get herpes. He initially says “I don’t know, how did you?” I explode with defensiveness. He then clamly explains I probably got it when I was raped almost 40 years ago and it’s been dormant. I go but what about initial outbreak? Wouldn’t I have had that?

He says wait for the STI test results, because the gyne could be wrong. They come back positive for type 1 HSV - the virus that is usually oral so he then says I must have given it to myself by licking my fingers and touching myself?! WTF? I have zero libido and it always hurts down there, I was only going to the gynae over and over to get prescription strength stuff for vaginal atrophy for him.

So he would talk about the widow now and then, chat with her on the phone. When he went up to help DC move out of student digs this past June, he was actually upset there wasn’t time to visit her before the return flight which I did not understand..because it’s been a year? Surely she is settled by now in her new life and home in London? She is back with friends and family?

He came back and got violent. I filed a police report, he was arrested and confessed to domestic violence. He is now under court custody until his tribunal. From 3rd info sources as he is banned from contacting me or me him, I hear he is hoping he is deported and is put on the first flight to the UK so he can go “home.”

He has made it clear he thinks he deserves half of everything despite the fact he beat me up and it’s up to me to file for divorce.

Why am I obsessing now? I have recently found a few photos on the laptop that to my eyes indicate a level of body language and closeness beyond the widow of a close friend level of friendship. I’ve looked at my records and the timeline matches up. I feel like a complete and utter fool.

The past few months, I have been asked by the police and other officials why do you think your husband became violent? All I had were excuses…grieving deaths, stress, unresolved trauma, my menopause & cancer caused compassion fatigue ?

I maybe had a eureka moment last night when frustrated with these feelings of utter betrayal and the fact as primary breadwinner, usually sole breadwinner, for over 30yrs of marriage why in the hell am I going to have to divide everything in half with this excuse for a human being? I am afraid for my own future financial stability. I’m a cancer patient so I’m not able to earn anything for the time being and the cancer treatment itself is causing more and more serious health complications. In my darkest nights I wonder if I am close to the end. I lose to cancer and there will be no retirement of rest and enjoyment? (I have a private psychologist I see weekly for €50 a session as the free one promised by victims’ assistance never materialised- absolutely necessary so please do not worry- I am doing all I can to survive this)

The authorities are illequipped because usually the divide in half means the abuser is compensating the victim.,.but in this case I feel like I’m about to be abused all over again by losing half of what I carefully saved up.

He kept cashing in his pensions so has maybe £20k total. He almost cashed that in earlier this year because he wanted to buy a fancy motorbike. I saved and saved and have 20x that. I didn’t mind sharing pensions when we were a married couple, because the deal was in sickness and health, for richer or poorer, til death do us part. We had a great retirement planned for ourselves using my pensions and his just being left to grow in case I die early so he has a bit to see him through the probate.

The only issue relationship wise was our sex life going out the window due to physical side effects I had and have no control over. Until he got violent that is.

I seriously thought my love and devotion since I was 20 years old would have meant that lack of sex wouldn’t have made him go so cookoo. I feel like I don’t know my DH at all, which is crazy after 32 years of marriage and raising children to adulthood.

So, sorry so long, but AIBU to suspect an affair for sex? Or am I BU and I’m demonising a normal late middle age divorce?

I'm so sorry you're going through this. It does sound like he's had/having an affair and has given you herpes. His suggestion that you've somehow infected yourself is ridiculous.

I think you need to get legal advice asap. Splitting everything 50/50 may be a starting point but there are other factors which a judge will consider, the fact that your health means you're unable to work would almost certainly be taken into account. Unfortunately, the reasons why you're divorcing him, and his violence towards you, have no bearing on the financial settlement. I hope he gets a custodial sentence though because he bloody deserves it.

You sound like a strong woman and you deserve some peace and happiness. I hope you've got lots of support from your children, family and friends 💐

I am not sure I fully understood everything but I would suggest you keep your money separate and in accounts he cannot access. It is clear he is not a good person and is not treating you well.
If you are in France you can have a marriage contract where your assets are not split equally (separation des biens). I assume you don't have this in place?
You also have an extra tax on any split assets when you divorce. Super unfair I think but is what it is. For this reason many couples change the matrimonial regime and then split assets before divorce. Does he know the value of your savings? You could offer an amount to him to change marriage contract and then just agree your savings are yours. Either way you will need to see a notaire

I think he has had an affair yes, but I think right now priority needs to be sorting this divorce and if possible getting him banged up for DV. He is not who you thought he was. I am very sorry this happened to you op and I hope he gets some karmic justice one way or another.

That's an awful lot to deal with... I'm sorry you're in this dreadful situation and having only recently moved to France too, that makes everything you're going through 10 times harder, I know.

But I can't help thinking your focus shouldn't be on whether he gave you herpes or had an affair.
Your marriage is over, he is no longer and definitely is not your "D" H. He has presumably physically attacked you, and while you are ill as well.
It doesn't matter now if he had an affair... it has no relevance in divorce proceedings these days. In France especially, it is impossible to have a fault divorce, if that's what you're wondering. You'd have to categorically prove the affair which you can't.

You should be concentrating on the divorce and freeing yourself from this awful man. He is no longer the same man you married. Accept he has changed and that he is no longer your husband.
For info, pensions are NOT taken into consideration in divorce in France, so it may actually be advantageous to divorce in France.
Your absolute first priority is to get legal advice as soon as possible. Get the free hour in both countries ASAP and make a decision where you will file for divorce. Once it is filed, it is near impossible to change the country of divorce, keep that in mind.

Thank you, those were the priorities I have been operating under. I’m in that limbo where the court date is set but is months away and from what I understand it’s not a trial as he has confessed/pled guilty. I think the tribunal is to determine the extent of the abuse and the sentence, as I’ve had to attend several interviews and submit evidence.

I haven’t mentioned a possible affair giving me an STI to the authorities handling the case because until last night I hadn’t had that eurêka connect the dots moment. I think I wanted to believe it was some bizarre accidental thing that happened because my immune system is shot from cancer treatment.

I am unsure whether to even mention it now though as I know reactions could be 🙄 of course the wife is going to allege adultery as well. I don’t want to go from obvious victim to suspiciously coming up with new allegations bitter harpy.

And yes you will both have to have an avocat each, the notaire bit comes after, they liquidate the assets. The priority is the avocat to get the first judgement in place.

Yes, I know it is over. I’ve packed all his things and put them in his office/den.
I know he is now someone I used to know.

I do also think I need to to just forget it, perhaps my instinct to not mention the herpes incident was right. It’s not really provable.

However, I was advised that divorce for fault is possible with a conviction for domestic violence? Thank you for comment on pensions, but I was told that only applies to annuities, not pension savings pots. That they will be counted as joint assets and I will have some very large lump sum I have to pay him to offset the difference in our financial assets.

Your absolute first priority is to get legal advice as soon as possible. - ty I have been trying for weeks! To get an appointment with a family law avocat that is.

It's now August, literally everything stops in France for the holidays, that's why you can't get an appointment until September. If I were you, I would get a free hour with anyone at all who is available. My avocat is 2 hours away, maybe try further afield in case someone has some availability? You can have the free hour and then not use them.
I do understand you're completely in the dark and worrying about your assets and until you've had some legal advice, you'll be in limbo, which is horrible.

I'm afraid 50:50 is normal but it will all depend on your ex's income and you've got all the proof to show that you can't work at the moment, so you may find you're entitled to a bigger share of the assets than him.

Sorry, I don't know anything about domestic violence and fault divorce. I guess it's easy to prove with a conviction... far easier than proving an affair.

I'm glad you've accepted already that he is not the man you know. It just worried me you were still calling him DH!!
You're on the start of a very hard journey but you already sound strong and informed. Good luck with everything 🤗

Thank you. Yes I agree it’s the August vacances. I think by the time I was making contact, July was all booked up. No one is available. I have looked at major cities by train even! I guess the plus is that with everyone taking a break, I can take time to process all this. My psychologist is kindly seeing me over zoom during her vacances this month so I can still see her weekly.

I understand the DH thing. Where I start, he was DH then but by the middle of the post he becomes STBX ! I’ve accepted it logically, but the emotional and financial fallout is going to dominate the next few years and I’m angry about it and hoping that I regain my health and get the opportunity to rebuild a new life. Going to try my hardest.

His income is zero. When we relocated, I agreed to early retirement for him. He is under state pension age and is certainly capable of returning to work in the UK. Unsure if he would be employable in the UK with a criminal conviction in France as his last positions required a DBS. But I would hope that his earning potential would be counted.

You will. One day you will have the peace you deserve.
You're being admirably realistic as yes, it will take years and your children will be affected too. But you'll all be stronger because of it. (and you've got rid of a nasty sex pest too from the sounds of it)
I'm sure your psychologist will have explained that the anger is all part of the grief rollercoaster that you've been launched onto. You're grieving the future you thought you and your children would have... it's not fair and it's not just and it'll take a long time for acceptance to come.
But live your life in the meantime and try to appreciate the small things, that's all we can do. I hope you're in a beautiful part of France and are able to love where you live and make a lovely life for yourself that is all yours, treasure it.

You can do a change to matrimonial contract post marriage. We did. And we hadn't married in France either.
Sorry this all sounds so hard for you. Hopefully a good notaire can help

I think it might be too late as I was told by the victim social worker assigned to me that if there was no contract to begin with, there is no contract to change as far as the French see it. She could be wrong, but given the situation it’s not likely he’d agree to any change that would leave him riding off with less cash.

Ah right. Could be. We had a joint property in France after marriage so I think that was when the contract matrimonial was established

Unless you have declared anywhere that your marriage is without separation, you can just state it is when you are asked.

We were married in the UK, and when we bought property they asked our contract, we said we didn't have one and they asked what we would like it to be, and that they could put whatever we preferred in that situation.

Just in case, I would say when you are asked about the contract that you were married in the UK but would like to use separation des biens. Let him go argue it otherwise.

Clear your money from the joint accounts quickly into an account that he cannot access. It will at least make his life difficult for now and he won’t need any money in prison.

But you have the doctor visit and diagnosis of the herpes, plus prescription (?) for the creams to show you were having intimacy with him. This is evidence of being being infected by him following a trip abroad.

Giving you herpes is abuse.
