Opps i messed up blue badge one…

Going to start with I am mostly house bound so rarely leave the house.
Today I actually went out and used my blue badge, got back ten minutes later (parking warden must of been hiding!) to a parking ticket saying my blue badge wasnt displayed properly.
I appealed it but Ive just looked at my blue badge and its 6 months out of date 😳

even though ive appealed should I just pay the fine of £35 and hope they dont take it further?
can i do that even though Ive appealed?
i know the fines can go up to a grand which i cant afford to pay!
Ive just appiled for a new one.

Essentially you don't have a blue badge, so I'd just pay the small fine and move on

You won't have grounds to successfully appeal this, just pay the fine as soon as possible and await your new badge.

You’d hope they’d apply some leeway, in the circumstances. Can you call the council and explain the circumstances? Ask them if you can withdraw the appeal?

I've a blue badge. Appeals do work. Over many years I have appealed three times in all and had the fine cancelled. I once didn't see the parking restrictions accurately and still was alright.
I'd wait and see before you pay.

Just pay the fine. And remember to keep the badge up to date. I don't think there's much point arguing about it. It was an honest mistake but the badge wasn't valid so that's the rules.

Leeway might be if the badge was a few days or a week over. This was six months!

Pay the £35 and nothing more will happen.

Another vote for just pay the £35. You were in the wrong on this occasion, annoying as it is.

The fine will be still at the reduced rate if you wait for their decision. You have 14 days to pay at the cheaper price from the date of decision if rejected.

Ps never go to faversham if you are likely to make a simple error of judgement. The only tickets I've had were there, one was because my daughters ballet class was literally on the edge of a car park and I parked there and ran her indoors, got her shoes on and she went into class, came out to a ticket. The warden must have literally pounced the second I'd left the car! The 2nd time my payment on Ringo didn't go through. So bloody frustrating paying for nothing

Don’t pay it yet! Wait for their decision, you have nothing to lose by waiting as the appeal pauses the time it needs to be paid by.

It is frustrating and god that’s annoying for you you can’t help if the app doesn’t work, there was 4 other empty disabled spots so it wasnt like I was taking up any spaces desperately needed.
And the council wonder why the high streets are dead! Should just be free parking for everyone.

Pay it. It's your responsibility to apply for a new one. How can you appeal the fact that you forgot to renew it.

I take the point in 'standard' circumstances; but when somebody is significantly disabled, it's not a level playing field when it comes to how much energy, ability and/or good mental health - or to put it another way, how many 'spoons' you have - in comparison to a healthy, able-bodied person.

If you're fit, active and out and about all the time, with an average amount of energy, you would surely notice something like this and deal with it promptly; if you're virtually housebound and disabled - unable to keep to a 'normal' routine like most people - it can be quite a different matter.

Ultimately, OP was in the wrong and thus has been punished with a £35 fine. I think, though, as a society, we should be looking deep in ourselves and asking if we really, truly want to have a system designed to profit from very underprivileged people for not having the wherewithal to do box-ticking admin for something that the vast majority of people are lucky enough to never have to give a moment's thought to.

Yes, I’d definitely appeal it. I think the Traffic Warden was being an arse not to simply flag it as out of date.

Fact is, you’re still entitled to the badge and to use the parking save for an administrative error regarding the renewal date.

I’d write and argue that due to your various disabilities that keep you mainly housebound, you don’t use the vehicle very often and you hadn’t spotted that the badge was out of date.

You’ve since taken steps to rectify your error and have posted off the renewal paperwork.

As your disabilities that entitled you to the badge haven’t changed, you expect to receive a new badge shortly.

You’re very sorry for the inconvenience this might have caused etc….

If you pay you are accepting that you committed the offence. Which you know you did but by oversight. And you have nothing to lose - as long as you appealed within the 14 days. So I’d wait and if you lose then pay.

Just because it was ‘an oversight’ that doesn’t mean it should be appealed. It was an oversight on OPs part so they now unfortunately pay the price of that. What if it was a speeding ticket, “sorry it was an oversight that I went over the speed limit”…. It doesn’t quite work like that

It absolutely wasn't meant to be. I said "it can be quite a different matter"; I obviously don't know OP's personal circumstances, but I know very well myself what it's like to have a seriously limited amount of 'spoons', but to live in a world where it's assumed, expected and demanded that you have as many as most 'normal' people do.

It's not patronising to those of us who are disabled to say that we face a lot of challenges in life that most people would never even think of. It's not a value judgment or critical; any more than it is for me as a white person to say that POC will face many challenging situations that I am privileged not to ever have to experience or consider for myself.

Regardless, if you believe that OP having to lose £35 for this oversight - when able-bodied people would never be in a position to be liable for this penalty because of their relative, unearned privilege - somehow makes society better and fairer, then I guess you're entitled to your opinion.

Making an active decision to drive over the speed limit and endanger others is absolutely not the same thing as being disabled through no fault of your own and slipping up in doing admin to slightly redress that challenges that you face that most people are lucky enough never to have to give a second's thought to.
