to be suspicious of nursery manager? (bit long ...)

totally willing to accept I may be being neurotic but here goes ... dcs go to a day nursery in a private house. The owners have a swimming pool in their garden. There is no fence around the pool but there is a very high fence with a gate in it (which kids could not open) separating their private garden and pool from the kids' areas. Three times now the gate in that high fence has been open when I've dropped dcs off. I have mentioned it to staff members who have closed it and today I told the owner herself that I was very concerned about it. She said that it was done deliberately as part of her health and safety risk assessment.

Every morning they carry out a boundary check (I think that's what she called it) and leaving the gate open from time to time was part of this risk assessment. She said it was to see whether children would go through the gate. Sometimes, she said, they leave the front door open for the same reason. Then she said it was to see whether parents noticed this sort of thing, and I had so well done! Now this all sounds insane to me but I know h&s can be insane. Could this possibly be true?

I don't get on with her very well anyway and have come close to moving them out before but as one is settled and the other is settling I don't want to fly off the handle.

How to approach not paying notice period? That one's easy: Tell her she has been grossly negligent and this has resulted in fundamental breach of contract on her side. By lying about the reasons she has also created a fundamental breach of trust.

Tell her that if she wishes to pursue it in the courts, then you are comfortable with that and with the idea of standing up in court and explaining exactly why it was dangerous to leave children on her premises.

My guess is she will let it go....

anotherbadnight - I know how you feel im not a "complainer" by nature either but just imagine how you would feel if you didnt report it and a child subsequently had an accident. That is what ofsted are there for and believe me parents complain to them about far less important things.

I have phoned and withdrawn the children and her response was really quite incredible. she said - and I quote - "if you would like us to stop leaving the gate open, this is something we could do".

She seemed to be standing by this risk assessment story. I tried to impress on her how dangerous this is and how she should never leave the gate open in any case and that it's just incredible to take this approach and that she seems to have fundamentally misunderstood how risk assessments should be carried out etc etc and it seemed to fall on deaf ears - she didn't even go on the defensive. Insane.

All regrets/ concerns about this have evaporated. I just hope Ofsted moves fast.

sorry - regrets I mean complaining to Ofsted. I regret leaving the kids there and I am worried for other people's now.

anotherbadnight - I think you are spot on with this. I went round a nursery (some time ago) and things were not at all right (wrong staffing levels etc). I reported the nursery (to the County Council I think??) and they did a spot check, confirmed what I had thought, and wrote a lovely letter to me. Best of all though, apparently since then the nursery has really listened, and has worked really hard to improve, which is great for all the children there.

hope you find a nursery you are happier with.

Next will it be " I left a BOILING hot iron or kettle on the side just to SEE if the small children touch it, THEN we can see how the staff react to an emergency" !!!!!
Move your dc's and report them. Iv'e never heard somthing so farking ridiculous!
GET THEM OUT OF THERE!!!!!!!!!
