To want the bin returning to me

I signed up to the council garden waste bin collection last year and paid full subscription for my bin. A few days after my bin arrived my neighbour asked if I could get one for her as it was cheaper for a second bin on my account so I did. I paid in my account and she gave me the cash. This year she won't pay but refuses to return the bin. Is it my bin or hers? It's registered to my address and she's had her years worth of collections. Thanks for your replies 😊

They are now refusing to return the bin and I assume planning to keep putting the bin out and expecting it to be emptied. They need to know it's no longer in op's posession or linked to her account.

If you said I could use your car to move some furniture and I paid you £20 but then refused to return the car, would it not be stolen? 🤔

But where did the cost of the second bin come from? Surely it was included in with the cost of the second subscription, therefore it belongs to the neighbour?

At our council your fees for the bin itself are separate to the waste collection service. So once the service ends e.g. after a year, whether you have a bin or not is irrelevant. So I'd say it's neighbours bin in actual fact, as she paid for the service. However, I do feel that both the neighbour and OP have been fraudulent here - as they've both agreed to a contract to hire a service at an address that the service isn't actually being used by.

The website states that you can share bins with your neighbours and split the cost so nothing fraudulent. The point is that she now won't contribute to the cost of the bin subscription.

Your neighbour was using you from the beginning and is just getting worse! I’d imagine in most cases if neighbours were sharing the cost of the bin then you should both be benefiting, so each paying half the total costs. Only she was benefiting from this arrangement. Report the bin she has as stolen before the collections start again in March so that they don’t bill you if she puts the bin out.

I believe the bin belongs to the council in most authorities. The fee is for delivery and admin.

Ask the council to collect “your second bin” and let her know that they took it because it wasn’t paid.

Doesn't your neighbour also need a sticker for her bin to?

Ring the council and explain if you’re concerned? Then they might just pick up the extra bin and not return it to her!

Our council know how many bins belong to each property, im assuming its a computer in the truck. All our neighbours had their 2nd/3rd/4th recycling bins removed late last year but all mine remained and caused a bit of an uproar. Turns out theirs are "stolen/acquired" bins from over the years whereas we requested more.

Ive noticed now all my 2nd bins (5 bed property) all have "authorised 2nd bin" labels on them so unless she puts it right next to yours they shouldn't empty it. If they do either try catch them and tell them or tell council, they may do what my council done and removed unauthorised bins.

Wait till she puts it out, then bring it in and hide it. If necessary , if it's still full (if they've refused it) then empty it into yours ,then offer it back to council.

First I would text and be careful and say Sharon please can I have my green waste bin that I have paid for (see attached receipt) for this year. If you want your own garden waste bin to need to sign up and pay for your own. Please return by tomorrow.

So isn't there a way for the council to check that an address has/hasn't paid for the service of having their bin emptied?

What would happen if you yourself didn't pay your yearly subscription, would your bin be emptied still?

When our council suggest sharing the cost with a neighbour it's one bin between the two of you and both paying half the cost each, wr wouldn't get a bin each.

Can you call the council and ask, just make an enquiry or is there any info in their online garden waste bumph?

As I said previously our refuse carts have an iPad device with all those that have paid a subscription, no payment gets you no bin emptied.

We forgot to renew our green bin and it wasn't emptied the first week, so I assume that they have a list in the van. We have stickers but when we moved they said they didn't matter if it hadn't arrived before the next bin day as it was all done on the computer.

So I reckon she'll put it out and they just won't empty it, unless you have continued the 2nd bin payment.

Yes they have the ipad in the lorry but the problem is if we both put bins out they could empty hers and not mine as they would be together. I can't be present as I'm at work when they arrive. I think she will put it out so I want her to return it to me.

You need to call the council .

You need to explain you will no longer require the second bin. Request that could it be collected from the address, as the person who wanted it is no longer agreeing to pay and you don't want that liability.

Make sure you follow up with them to ensure it has been collected - so that (like you said) there is no danger of blowback to you.

Once that's done, if your neighbour kicks off, then good! You can remind her that this is a paid service. If you don't pay, you don't get it.

I think people are outrageous sometimes in the UK. They get used to something, then expect others to shoulder the costs.

Tell her that if she wants her garden waste collecting, she can make her own arrangement with the council but now will have to pay more money.

Or she can pay you the reduced rate and consider herself VERY lucky as a result.

She cannot however try and sit this out, and hope that somehow the council "won't notice".

If you get billed for this, you'll be fuming - it's all so avoidable.

Just call the council.

Have you checked with your neighbour that she is intending on putting the bin out? It sounds like you're worried that, come March, she will put it out in the hope that it'll be emptied, but she may not. She can't pretend that her bin belongs to your house number, because that's not right! So if she is e.g. 6 and you are number 8, it's wrong for her to stick a bin with 8 on out this year, because her bin should have the number 6 on it! So just ask her to give you the sticker on the bin with the number on it, and change her bin to her house number.

It'll be irrelevant that both bins are registered to your address, they'll only empty the one where the number on the bin matches the number on their ipad.

Surely your neighbour will have to also put your door number on their bin inorder for it to be emptied.

Edited to add if you've only paid for one bin subscription for this year wouldnt that also be noted too.

i’d phone the council if that option is available - round here it’s all online portals. anyway ask what you should do with the second bin as you no longer need it and a neighbour wants it.

see what they say so it’s either unregistered to your address somehow, possibly reregistered to hers (you may have to get her on the phone if they ask for that as all this gdpr shite these days matters, or returned.

you can have somwthimg linked to you kicking about in the street in case something happens and you get into trouble.

that way you've followed the rules.

It’s not your bin. The subscription pays for it to be emptied- the bin itself remains the property of the council.

Even so ..

Neighbour: My neighbour came onto my property without permission to take back her bin because I wouldn’t return it.

I would just go and get it. Trespass or not.
