Sick leave annual leave

So I am back at work about 2 months after being in long term sick. I had booked one day a/l a few weeks ago but I got flu the day before my a/l and the day after. As I had so much a/l to take upon returning to work I asked my manager if I could take these sick days as a/l instead. I just got paid this month and I am down over £500. I'm so pissed off. She must have recorded it all as sick leave or 2 separate sick leaves. Is there anything I can do? I'm really going to struggle this month being down this much pay.

£500 take home for 3 days is around 60k full time before tax (I think!). If you're not on anywhere near this then something else has gone wrong.

She couldn't if it had gone against policy and potentially gotten her into trouble.

This wouldn't be allowed where I work, sick has to be recorded as sick

Lots of businesses don't allow you to use AL instead of sick leave.

I assume you went back to work from a period of illness just before your pay was affected (so you are paid sick leave for 6 months, but then go down to half pay after 6 months)?

If this is the case the 2 days might have tipped you into the 6 months because it’s calculated over a 12 month period?

You need to check your sick policy and speak to HR about future sick leave implications if this is the case.

You can ask to take annual leave instead of sick leave, there is no issue with it legally. It might be against company policy though.

OP-I suggest speaking to your manager, it sounds like it was logged incorrectly. Hopefully they can ask payroll to amend and make a BACs payment to you before payday so you are not out of pocket.

I work in the nhs and sick leave is not allowed to be taken as annual leave. You need to check the policies for your individual workplace/ company.

If the employer has been told that the employee is sick and unable to work, they may be eligible for SSP. Once the employer is claiming that, it can be considered fraudulent to then withhold those funds from the employee and give them annual leave instead.

It also could cause the employer difficulties if it later came to light at Employment Tribunal that they had not kept proper records of an employee’s sickness. For example, if that absence was related to a disability.

Employers haven't been able to claim back SSP for years, are you in England?

The solution here would be to ask for a Stringer payment ( that is what it is called in the civil service) the days are correctly recorded as sick for attendance management and potential ill health retirement purposes BUT you can use up a days AL at the same time to get the pay for AL. Most commonly used when the employee has gone onto nil or half pay. You need to ask for this specifically (this is what the ACAS stuff upthread refers to) what you can’t do is say oy boss stick me down as AL for my sick days without explaining exactly what you want (even if boss has done this in the past - and probably got grief from senior management for it)

You cant declare you have had £500 deducted forb2 days sick but say you dont earn that much. The 2 things cannot be true.

Either you are on £30/hr or you weren't deducted £500 forn2 days sick leave.

Yes I do earn £25 an hour a d work part-time.
