EBay Nightmare Seller - Help!

In late Sept, I bought a marble fireplace surround on EBay. It is a quite distinct marble and was a good price - also, according to the measurements given in the "Item Description", the hearth section would fit exactly into an existing alcove in my wall.

I paid just over £3,000 inc. £54 EBay Buyers Protection. The advert stated "Collection only in person."

The seller was only about 3 miles from where I live and contacted me to say the fireplace still needed to be safely removed from the wall, but he would contact me as soon as it was ready. Fine.

He contacted me in late October, advising that the fireplace was now deconstructed into 4 sections, and that 3 men would be needed to move it. He said they would need Correx (protective materials), plus blankets to protect the marble.

Some of the builders working in my house agreed to go. But on arrival, they called me from the apartment ( a luxury Chelsea penthouse with lift access) to say no way could they move any of the pieces.

I called Chesneys (where the fireplace was originally bought years ago) to ask for recommendations for professional fireplace removers. They put me in contact with a team who said they could do the job.

On arrival, the main guy in this team called me to say no way could this marble be moved manually. By coincidence, he was the one who had actually fitted it in the penthouse, 8 years ago! He said back then, it was craned in! This was possible then because the apartments were still under construction. But now there is high spec marble floor finish in the lobby area which, even if the fire surround pieces could be moved onto the skate trolleys they had brought, could crack under the weight. He said the marble couod not be moved manually. It would need mechanical aid, but this would be tricky due to the limited size of lift and who wants to risk bringing machinery through an apartment complex where all the finishes are high end luxury.

I called the seller and told him all this (well, he was on site and had been told as much himself). I said it was unreasonable to expect me to hire commercial machinery, etc and this has not been made clear in the collection info. In fact, there was nothing about unusual weight requiring industrial moving arrangements.

The seller said he had a contact who could do it. When I rang the number it just turned out to be AnyVan. I paid over £1200 to have a team if 4 show up with heavy duty lifting braces, heavy duty skates and a van with a mechanical lift on the back. They showed up and called me to say they could not even lift it an inch off the ground.

The seller is still refusing to give me a refund, even though it is now clear that it is effectively impossible to move the marble onto a skate - let alone out of his apartment! It has also emerged that he stated the wrong measurement in the item description, so the hearth section would not even fit into my alcove, even if I was able to get it here.

I managed ti call EBay customer services who say my EBay Buyer Protection expired in late October. But the seller only took the fireplace if the wall then! EBay are looking into it but can make no guarantees. The seller is ignoring my messages via the EBay chat and WhatsApp.

Can you open a case of not received as there is no way you will be able to receive the item. Also it should not have been listed as collection only as it wasn't. When an item is collected the buyer has to scan a QR code on the sellers phone to confirm collection. There must be a way round it.

He's taking the piss, you should have sorted it before your insurance expired. Now that it has, you're in trouble. He has a dismantled fireplace he wants rid of, and your money. Maybe try to go halves on the cost of a specialist team and equipment.

I don't think there's much you can get eBay to do, as there are strict time limits to open a dispute.

It sounds like the seller has strung you along. And paying the money upfront probably wasn't the best idea.

Could you take him to the Small Claims Court? First of all write to him asking for your money to be returned as you have not being able to receive the fireplace due to it needing to be removed (taking weeks) and that now it is proving impossible to transport from his property to yours.

If you're out of time with ebay then hopefully you paid with a card?? If so contact the card provider.

If you didn't pay with a card then you will need to send a letter before action claim to the seller giving them 14 days to refund otherwise you will yake court action.

You will then need to decide if its worth the risk of taking it to court. If it said collection only and the seller is leaving it available to collect then the court might decide in their favour. If the original installers are are willing to put in writing that they installed it before the building was complete so it would now be impossible to remove then that would win you the case.

I'd say credit card protection is probably your best bet.... just focus on the mis-selling dimensions and nothing else really matters.

Agree with this. Credit card protection section 75 is your best bet

Thanks. I will wait for EBay to come back to me, otherwise will take it up with my bank. I have statements from 3 professional teams that the fireplace is impossible to move without industrial equipment.

"Collection only in person" is standard Ebay phrasing. It does not implicitly mean that the item can be moved by a person rather than machinary.

I think that you need to shoulder some of the blame here. You have bought £3k worth of mable and it does not sound as if you made any enquiries as to the weight or how it got into the property in the first place.

Why on earth did you pay for something that wasn’t available at the point of purchase? Collection items on eBay normally have a QR code that is sent to the buyer that seller has to scan on collection? Did you let them scan your code even if you hadn’t collected?

I'm sorry but I've got very little sympathy for you and that money is probably gone now. I can understand you not knowing the buyers protection is only for a month if you don't use ebay much. But when professionals, who do marble fireplaces for their JOB, say it's not possible, what the hell was doing through your mind thinking it's OK the pros can't do it but 4 amateurs with a van can? I try and see the best in people, but really you deserve what you got there.

The only possible way maybe to get anything back out of this mess, is doing a claim through your payment method. Did you pay by PayPal or credit card on ebay? I suspect you are out of timeframes for claiming through them too, but it's worth asking!

Who knew there were so many marble fireplaces for sale on eBay - I’m going to be a little more sympathetic to you as I think that in addition to what you’ve since found to be inaccurate measurements the seller was very economical with the information he provided about its location and the requirements for collection. In my view just to say collect in person isn’t good enough, and all the more so when you read eBay’s listing requirements.
If it’s the listing i found from the info you provided, I couldn’t see mention anywhere of the fire place not being on the ground floor or that particular care in removing it would be needed in view of the high spec of the surroundings.
eBay is very clear in its instructions to sellers that they must provide buyers with clear and accurate location information and I think that you could legitimately argue that the seller failed to do this - It may be worth you taking a look at its item location misrepresentation policy.
As far as the buyer protection fee is concerned - what a waste of money. Common sense surely dictates that it’s one month validity should only kick in once the buyer has the item. You haven’t had the fireplace yet.
I’m assuming that you are not on your beam end financially and in your shoes if a refund wasn’t offered I’d be taking legal advice about this - in my view neither the seller or eBay have fulfilled their obligations .
That said, it almost beggars belief to me that you were happy to pay out (what would be an absolute fortune to me ) when you did, and seemingly without asking any questions. As my dad would say - more money than sense.
