CF estate agents

House next door has gone up for sale. Photos online show a driveway and description includes statement about off road parking.

The estate agent has manipulated the photo and fails to show that the house does not have a dropped kerb. Access would be via my double drive.

This is advertising with deception. What can I do?

I'd put in writing/email that they are falsely advertising your property as part of the adjacent property sale, address it to the office manager or similar, I'd also speak to any viewers and make it clear there is no access via your drive. Is there any way to block it?

I've got a H marking as people park either side and cut off part of my access. I will contact the estate agent but is there a law of rule about this?

Well yes they have to accurately advertise the property for sale and if they are showing your drive as their access that's false. I can't take a picture of a Ferrari with a fiesta in the background and claim everyone should've known it was the car at the back for sale.

I seem to recall reading on here before that a driveway without a dropped kerb is merely a concrete front garden.

A quick google suggests "Driving over a standard pavement without a dropped kerb is illegal, and you could be liable for any damage caused to the pavement or underground utilities." Whether or not the council would enforce this is another matter, but I would suggest you contact the estate agent to point out they should not be describing it as a driveway as it doesn't have a dripped kerb. I would also be inclined to put some heavy plant pots on your driveway next to the boundary line, so anyone viewing the property will realise they cannot access the next door property via your dropped kerb.
