C100 specific issues order

Has anyone used a c100 form and being successful to allow mum to take kids abroad on holiday ?
No contact with father due to domestic abuse , doesn't see children as he is a prolific criminal and children would be at risk , although there is nothing in place legally. No contact for 4 years.
Can I apply and pay without a lawyer and maybe help from womens aid ? And did you apply for one holiday or use it for any future holidays for permission from court so you don't have to keep applying .

Why do you need to apply to take them on holiday? If you are the resident parent you can take them away for 28 days a year without permission. Also if he’s not in their lives why would you need his permission at all? It would be down to him to object legally.

28 days only applies if you have a court order stating the children live with you

You’re still the resident parent whether you have a court order or not. He would have no grounds to stop you taking your kids on holiday. As long as you have a return ticket it’s not going to be an issue.

If there’s no court order she can’t take them abroad.

I was stopped coming back from a holiday and questioned - I had a letter from my ex permitting the holiday but I personally wouldn’t risk it without that or a court order.

We took our stepson abroad with us before there was a court order in place. We weren’t asked to provide proof his mum consented just that he lived with us. It makes sense you need this if the other parent objects but surely if they have no contact they aren’t going to stop you.

OP, either way you can do it without a solicitor I did all our submissions without one. You can get half an hour free legal advice from most family lawyers so I’d use that and submit it yourself.

Incorrect. This is only if you have a 'Lives with' order, as OPhas mentioned. Why don't you apply for this, OP?

You can make an application to the family court without a solicitor (and lots of people do). However, please think carefully before you choose to go down this route. If you apply to the court for any sort of order then they will contact the father to ask for his input. Will this be problematic for you? Is there a 3rd party who could speak to the father on your behalf to get a letter of permission for holidays instead?

The father isn't traceable , he has blocked me on everything, I don't have any family and don't have any contact with his family x
