Council “Enforcement Officers” with card readers for spot fines? Or Scam?

Yesterday I was walking to work in a major (non-London) UK city.

I passed by a scene in which a guy dressed (albeit scruffily) in official-looking clothes with a hat marked “Enforcement Officer” was accusing a passer by of littering.

I didn’t see what led up to it, and it’s entirely possible that the other person had littered.

The enforcement officer had a card reader in his hand and was telling the person that they had to pay a fixed penalty on the spot or else they would be prosecuted.

I thought that council officials couldn’t issue penalties that are “payable immediately”
but rather to issue a ticket with details of how to pay or appeal.

Did I witness a scam or is this now a thing?

On other occasions I’ve also witnessed “enforcement officers” arguing with people refusing to give their details, asking for ID and saying “then you will have to wait here while I call the Police”.

Is there a change in the law? I thought there was only an obligation to
give your details to a proper police officer and that a council employee has no right to make someone wait or hand over their details.

Am I wrong?

From what I’ve just googled (did you??) they have police powers to obtain your details, but I guess they can’t arrest hence they call the police if you resist.

So I saw a council web page that says their powers are from section 50 of the police reform act. But when I’ve read it, it only talks about police officers taking details…. Hmmm

Scam. Who honestly has the dosh to pay a on spot fine these days? It would just create more paperwork for the council and they know it would.

No, a spot fine means the fine is issued on the spot, not that it's payable on the spot. Sounds like a scam.

Yes, definitely a scam.
Anyone can buy mobile card reader machines now which are being aimed at small businesses & traders - they're even advertised here on MN. Realistic uniform can be bought fairly cheaply from online uniform shops or even on Amazon or eBay. It's definitely the type of scam that can be set up fairly cheaply.

I think that you have to be given at least 30 days to pay a penalty/fine and you have the right of appeal so this is highly suspicious. Can you give a general idea of what part of the country you've seen this @OneAmusedShark ?

That sounds dodgy. The card machine one.

The second one is true, they try to say that to force you to give ID or your address but they have no legal rights to physically hold you there. But the police wouldn't do anything as littering isn't a crime.

So if you run away they can't drag you back type thing. I didn't know this and gave my details. Paid the £80 fine they sent in the post.

My friend had one following him the other day and we went into the pub so he went away?!
