Angry at house seller?

Had our offer accepted, in the middle of the legal process and we’ve had got the fixtures and fittings form from the vendors.

They are taking with them all the column radiators (will be replacing with basic ones), all light fixtures - they had these beautiful sconce marble light fixtures that they will be taking and they are have a fixed mirror in the bathroom, has Bluetooth and different lighting and they are taking that too.

My partner doesn’t seem bothered but I’m really upset, Aibu?

The radiatiors are weird. But they are replacing.

Very unusual to take radiators.

Light fittings I can kind of understand but I still think it is stingy.

Did you knock them down significantly on price? Maybe that is why?

I always went by the rule of if something is fixed permanently to the walls/ plumbed in then it would be staying. So things like fitted furniture, light fittings, kitchen cupboards, radiators etc should stay.

I've honestly never heard of anyone taking radiators with them when they move house. That's ridiculous and I would be pissed off too.

Even if they replaced the radiators, there might be a mark on the wall where the original ones were, sunlight over time darkens some paper and paintwork.

The wall light fittings, I would also expect to stay as any replacement might not exactly fit. Mirror, I could live with and replace.

I would seriously consider pulling out as the sellers have strange ideas about fixtures and fittings.

Anything that doesn't fall out if you were to turn the whole house upside down should be left.

Theres a legal difference between fixtures (things like radiators, kitchen cabinets etc) and fittings (fridge freezer, curtains etc).

Some seem to come on AIBU just to be contrary, but it definitely isn't normal or expected for vendors to take things like radiators, and frankly if you go ahead I'd wonder what else you'll find missing

I’d be concerned about holes in wall / messy walls. Are they planing to fit new radiators (presumably standard shape) and repipe/plaster/repaint and the same for the space where the mirror is. I’d speak to your solicitor it needs clarification

Taking the radiators is really weird, but I don't see a problem with the lights and mirror. The Bluetooth bathroom mirrors aren't all that expensive, so you could replace it easily.

YANBU, you can work out how much they're worth and consider an adjusted offer - radiators would usually be left. Expensive light fittings would be expected to go I think.

Unless stated in the particulars then nothing wrong with taking the light fittings and mirror

radiators are a bit odd though so I would push back on those

when I look around a house I expect everything ‘decor’ to go but expect integral items (bathroom fittings, radiators, boiler, white goods etc) to stay unless mentioned

I once saw a house where the owner had hand built a beautiful wooden kitchen and they were taking everything. They declared it up front so fine.

My non-legal opinion is that it is deception of sorts. Perhaps if the government does get round to changing the law in England and Wales for house sale and purchase, it can state what is presumed to be included unless explicitly stated otherwise in all advertising.

Yeah, the radiators are fixtures and the replacements could be of a lesser design feature or decor could be damaged when they swop them out and on this basis, I would suggest you get your solicitor to either ask for a reduction in price or that they are still part of the deal.

Light fittings and bluetooth bathroom mirror are a bit of a push as its not unreasonable to take them.

Taking the radiators is weird but, I suppose, if they had them before the viewings, would that have changed your offer? Maybe think of it like that.

I hate vendor pettiness. One of mine took the light bulbs.

Had one who took all the carpets - except stair carpet. Fitted wardrobe doors,
All the light bulbs. This was in the days before you had to do a list. They smashed a window in the front door and left a load of dog crap in the garden so that was nice !

From a legal perspective if the photos of the house show the radiators and/ or they are mentioned then they are fixtures and they should be included with the house purchase. If they're not then I think you have a good argument that the estate agents details were misleading.

As a general rule if you turn the house upside down, anything that falls out is not included in the sale.

I would be arguing with the vendors tbh. It depends how much you love that particular house and whether the radiators and bathroom fittings were an intrinsic part of what made the house desirable from your perspective.

So dd2 had her seller try this bullshit 2 years ago.
They basically were waiting for her to start offering money for them.
i told her no!
instead she insisted and instructed that all damage and holes be fully repaired and left in decorated state that matched property when she viewed it.
slso new gas safety certificate and guarantees for new radiators and electrical work to replace what they were removing.
they never took any of it!

Personally, id pull out of it.

But if you are going continue then this is solid advice. Also, id be pushing for your solicitors to hold on to some of the money for at least 6 months to ensure that any plumbing problems with the radiators can be paid for and not by you.

The mirror I wouldnt be fussed.

Having google the lights, they're not my cup of tea but are pricey so again, ensure the lights are suitably replaced with no visible damage to the walls and a electric safety certificate is supplied.

Pretty certain they can't just take radiators as they're attached to the walls.

If they take them and replace them with normal radiators it's going to really mess up the walls, unless they have the walls of each affected room completely repainted, which I imagine they're not planning on doing. Also the rooms will look completely different without the existing radiators.

Very much something that needs to be discussed with your solicitor.

I'd be very tempted to pull out of the purchase tbh.

Speak to the estate agent, express your incredulity at the bat shit craziness of taking the rads (they will absolutely agree) and get them nervous that you’re going to pull out/renegotiate the price. They’ll be in the phone to the vendor explaining the error of their ways immediately!

Possibly, @DancingNotDrowning - or if they want an easy life OP could well get some youth in a shiny suit trying to pretend that everyone does this Hmm

Like others I'd pull out, but a solicitor's fee could be money well spent against any other crazy ideas which may possess the vendors

if you still want to buy it without thise things I'd go for a cash settlement as putting in cheap 'replacements' would be a waste of money & do damage

Buy them yourself if you like them.

No, taking radiators is a new one on me as they form part of the central heating system. Light fittings, yes. The bathroom mirror? Wtf for a wired in one. Done properly removing the radiators could be fine, but you're not getting any say in the matter, it could result in damage to decor, etc. Unless they're doing it themselves it could cost them a lot if it's every radiator.

Our sellers invited us to pay for the period style light fittings. We declined and they left them anyway as they would have looked right in their new modern place.

I can hear DP saying this is ridiculous and we could be moving into somewhere that needs lots of work immediately if they're going to behave like that and we are having second thoughts and will have to think if we want to proceed!

Either you've pissed them off in some way or one of them, I'll guess him, is a penny pinching git who thought they'd get more for the place.
