To think this is fraud?

I tried to cancel my account with o2 today. They offered me a better plan for half the price I'm currently paying so I agreed to go ahead. When the contract was emailed to me I noticed that my very old address was on it which is odd as I updated my current address with o2 when I moved in. The advisor was insisting this was fine and that they would update my address following me signing up to the new contract but I insisted that I wasn't going ahead with a legal contract with an old address on. They were persistent to say the least. I ended up totally cancelling my contract with them. I wondered if it is fraud knowingly signing a contract with a false address on as I think it is, but the advisor clearly didn't care.

Fraud requires intent to dishonestly gain money or gain something without payment. So no. But there’s nothing wrong with wanting legal contracts to be correct.

I think that in your position you were just being cautious. Which is not a bad thing. The normal response from them would have been to admit their mistake and resend the contract. That they wouldn't is odd. Could be dodgy, but more likely just a lazy worker who wanted to meet the quota of sealed deals for the day or week. I once worked in a call center where we had targets and certain workers would sign people up for stuff they didn't want or need or refer people just to meet targets. In your case the delay of re-sending might have affected hitting the target this week if you see what I mean.

Either way, fine to walk away.

I can't see how this is fraud but using words incorrectly seems popular in the last day or so it sems

Yes it would have been fraudulent of you to knowingly use an old address, you could run up a huge bill and never pay it. The NHS also class using the wrong address as prescription fraud.

How? The service is already being provided at her current address.
