Worried I'll be let go for 2 sick days in 6 months

I am leaving the role in 2 weeks for another job so it may not matter, but I'm currently employed through an agency so I'm aware I have no rights.
I had a day off sick 4 months ago after the death of a relative. Then last Friday I had a day off for d and v, it led onto the weekend so didn't need the 48 hours.

The policy states up to 2 occasions and/or 4 days in 6 months. I've been there 6 months so I've reached the 2 occasions limit, I highly doubt I'll take any more time in my remaining 2 weeks.

Nobody has said anything, but a colleague of mine has just been sacked with zero notice. He was admittedly off sick a lot, almost every week.

I know I'm within the limit but I still feel worried due to being agency staff.

Unless there's other issues, it really doesn't seem worth their time to sack you when in two weeks, you're leaving anyway

OhDear111 · 01/10/2025 07:55

You are going anyway. Not worth their effort to look at this. It’s minimal. It’s not every week.

tilypu · 01/10/2025 07:56

You haven't breached the limit, and the person they let go was off significantly more.

They've just let go of someone - chances are they need you right now. Don't worry.

EmeraldShamrock000 · 01/10/2025 07:57

Don't waste your time worrying about it.

Cow00000 · 01/10/2025 07:59

Thank you. I know they said up to 2 occasions so I've not gone over that, I just know agency staff have 0 rights and security.

Will they need you? To finish some projects perhaps, or handover/train someone else?

You're right that as agency staff they can choose to let you go any time they like, with no reason given.

I suppose you need the 2 weeks income, or you wouldn't be worried? Can your agency find you 2 weeks work?

No i doubt they'd need me, I work in a team of around 15 in a call centre so I'm basically just a number. They would hopefully be able to find me something else, I'm sure other team members have had 2 instances of sickness and are still here, I think my colleague was just an exception as he took so much sick leave. I'll try not to worry

Well I hope you're going to a job with some security and where you're not just a number. Good luck!

Why did you call in sick for bereavement ? Really that should have been classed differently like compassionate leave or just unpaid leave

OhDear111 · 01/10/2025 11:42

@CoastalCalm I was thinking that. Most people would be allowed a day unpaid for a funeral for example if it’s not a very close relative such as a parent. Then it’s compassionate leave and there should be a policy that covers this.

Tryingatleast · 01/10/2025 11:46

If they sacked the colleague and they really were sick, wouldn’t that be illegal? Isn’t that clause illegal? There’s a thread on asking why people come in sick, this is why- I’ve never gotten to just run and tell someone I’m sick, there’s a huge interrogation- I once had horrendous chest pains over a night and rang and they nearly convinced me to go in (I ended up in hospital for a few days later that day!)

Ok well I'm in work today and I've literally just heard my manager whispering to his manager about my sickness, saying is this now a trigger alert or something...great.

You weren't even sick for the first absence. ETA I see you took it as a sick day. However there's no reason why they should sack you at this point.

OhDear111 · 02/10/2025 10:45

Before 6 months is up an employer can let an employee go. And persistent sickness month in month out is a reason for dismissal. They simply are not doing the job. 2 days in 6 months is negligible though but no company wants people throwing sickies when they are not sick.
