AIBU to leave before serving my notice?

Have recently got a new job and handed notice into current job. Leaving due to terrible management and staff members being bullies and repeatedly reported with no action taken etc. I feel anxious coming to work because of the people and just dislike the job in general.

AIBU to consider just leaving before the end of the notice period? What can the repercussions be? I don’t ever want to return and don’t need a reference.

If you dont need a reference phone in sick with stress? Can't you use up leave as well?

Theoretically it is breach of contract and they could come after you for losses caused by your failure to work your notice. In reality, they don’t do anything other than state you didn’t work your notice in any reference

Refusing references or including your not working notice in the reference is the only likely consequence.

Theoretically they could take you to court for breach of contract but unless you're highly valuable to the business in a very senior role it is not likely it'd be worth it for them.

If you don't need a reference from them then just leave. Think worst they can do is not pay you your notice period and not give you a reference. Good luck in your new job.

Depends what your contract says, they can sue for breach of contract, however unlikely, your contract might allow your employer to make deductions from your final wages to cover their losses.

Are you planning on starting the new job before your notice period in the current job ends or just not working for that period. If you are not planning on working, then could you call in sick for that period?

I’m planning on not working for the period of time that I have in between jobs which is a week or so. The part of me that’s had enough wants to sack it off but I feel bad knowing that they’ll be short of staff as I have some lovely colleagues too! But then life’s too short to be anxious coming to work!

You can self certify sick for 7 days. After that you need a sick note from the GP. How many days are left on your notice period?

or go in and work to be nice to the nice colleagues and just walk around smiling and laughing and not feeling anxious as you know you'll soon be gone? You may find the anxiety is way less under the new circumstances and, really, showing you dont care and are on to bigger and better things is really the best way to deal with bullies. It will make them feel worse.
