AIBU to expect compensation after data hack?

The company I work for has another company that looks after employee data. I found out today that this second company was hacked and criminals have accessed my NI number, passport number and drivers license. I’m absolutely fuming! All they’ve said is to check Experian to see if anyone has made any applications in my name, but in my mind this isn’t enough. Someone could use that data today or sell it on and sell it on again with multiple opportunities to steal my identity.

What can I do?? Is there anyone out there that can offer advice? Surely there should be compensation for this?

What are you seeking to be compensated for? As of yet you've suffered no loss? Your current eligibility for compensation is £0.

Good luck proving that in court.

The OP would also need to demonstrate that they'd taken reasonable steps to protect them from loss in the knowledge that their data had been breached.

So change your passwords etc

Your only course is to complain to the ICO. They can fine the company if they were negligent, you have zero recourse for compensation through them though.

I was part of the British Airways hack. My pension fund was hacked and they got my data. All they offered wS free Experian. I wS ok with that. I never experienced any financial loss.

DH or I get at least one of these data hack letters a year. All that is ever offered is free credit monitoring.

after the first few you just stop worrying. Just like after the first couple of times your credit card is stolen. You get old enough and it is going to happen. Have contingencies in place and just roll with it. It’s just part of modern life at this point.

Same happened at our company and we have been given a monitoring service as compensation.

Do I know you OP? Currently going through exactly the same thing which happened over the summer. They only got my NI number and email address though. I don’t think you’ll be eligible for compensation but we did get told today we will be reimbursed for the cost of replacing or reissuing drivers licenses and passports if required.

In all honesty it’s going to cost me money now to feel financially safe. It’s £15 a month for Experian (no they haven’t offered to cover this) and that’s just one of three major credit reference agencies. Even if I do all three and somehow pull £45 out of my arse every month (which I do not have) I will still be more vulnerable to other forms of identity theft than I was before the breach. I can’t change my NI number or drivers license number, so that data will always be out there. It’s £95 to replace my passport. Adding up the money it’s going to cost me to keep myself as financially safe as I was before the data breach over the course of my life is thousands! And it’s not enough to say that so long as it isn’t used I haven’t suffered financial harm, the statute of limitations is just 6 years but two of these three types of ID will be in place for the rest of my life.

Contact the ICO for advice.

Why not all ask the company to provide the credit check fees for you?
