To not want my neighbour attaching a gate to our wall

We are rebuilding the garden wall between our properties. It's our wall.

The neighbours have a small garden gate attached to it. It's not a security gate. It was there before we moved in.

They keep drilling holes in the wall when their gate falls off. We've always known we'd eventually replace the wall so just ignored it but now we'll have a lovely horribly expensive new wall I dont want their rusty gate attached to it or the holes it will make. Our gate will be attached to it.

We are a terrace and they have a habit of assuming they can do things to our house eg they messed about with our guttering. I know they'll moan when we take the wall down because they wont have a gate and I know they'll just attach the gate to the new wall without asking.

We have a civil relationship but nothing more.

Am I being a bit daft? If not, how can we stop them attaching the gate?

Does the gate serve any purpose, is it for access or right of way, diagram?

Is their gate at the front and the hinges attach to the bricks from your wall at the side, can the builder put an extra side row of bricks they can use instead which they can pag for and speak to you about

It depends is the wall 100% on your side if so they have to put up their own fence post on their side. However if the wall is on the boundary they are entitled to fix the gate to their side of wall

It's a very good question. Call my cynical but I am imagining they don't want to make holes in their own brickwork. Weight bearing holes, anyway.

If it helps to keep the peace, OP, if it's a metal gate that can't easily be cut down and there is no wiggle room widthwise for an extra post you could allow their gate post to go on your boundary line. They'd save the expense of replacing the gate and your wall would be preserved.

You'd still need a metal bracket to attach the catch too

I don't see how they could attach it without asking. There wouldn't be a space for it? And they can hardly start dismantling the wall.

If they have no right of access into your property via this gate then it has no reason to be there so just put the wall up. They might moan but tough.
