Tree Damaging My Fence

Good afternoon mumsnetters,

Basically the garden fence that's on my side, ie 'my' fence, I replaced about 5 years ago. It's a good one, with concrete base all along the bottom and concrete posts.
Neighbour put his house up for sale about two years ago. Before this he noticed his tree was hugely overhanging my fence and very kindly offered to cut it down. Or so I thought
Fast forward to now. We have new neighbours. Now that the weather is nicer, I have been going out into the garden and have realised that my garden path alongside the fence is lifting due to the tree's roots. Also, the tree is growing back and is overhanging again. In addition to this, I have noticed that where the tree is, the concrete base is cracked as is the post. And the fence panels are starting to warp.
It looks as thought my previous neighbour only cut a few branches and didn't remove the tree properly.
Am I being unreasonable to ask my new neighbours if they would cut the tree down? Because the path is getting worse, and also I don't want the tree to keep destroying my fence when I'm the one who is going to have to buy a new one to fix it.

No absolutely worth an ask, I’m bordered by hedges rather than fences and a tree was growing on my boundary but the branches seemed to spread more over into neighbouring garden. They knocked my door and asked if I’d mind them pruning some of the branches back from my garden as was easier to access them than from theirs. My reply? Just take the tree down if you like! They subsequently did - wasn’t big enough for a tree surgeon the chap did it himself. It was on part of my property I don’t go down so hadn’t realised it had become a nuisance. Plus it was a pesky sycamore and I’m constantly battling them in my (very rural west coast) garden 😩
