Car insurance advice, why is this happening?

Someone rear ended my partners car a couple of mths back. It was reported to his insurance and the car is all sorted but we still haven't got our excess back. Last time dp spoke to them there was some sort of issue with the other party and he was told there was an investigation going on (by the other party's insurance company iirc). We thought maybe they hadn't reported it or were denying responsibility? Today the insurers sent a text to say they're now involving solicitors. Does anyone have any idea of what might be going on and why solicitors are now involved? Insurance companies don't do this lightly? Dp can't ring atm and I'm nosey!

If your partner was rear-ended, there is a high likelihood that the third party was at fault. In most cases, your DP should therefore not have had to pay his excess at all. Insurance companies tend to engage solicitors when liability is disputed and solicitors may encourage the parties to accept a 50/50 settlement where liability cannot be ascertained. Has the third party not accepted full liability for the collision?

It most likely means the other party has denied fault.

I had an accident, where someone drove into me, low speed impact no real damage to my car. Only painwork damage to theirs, but they denied it was there fault. After a conviction with my insurance company giving all the details, they where like yes it was her fault. But as she denied it they had to go down the league route as she was trying to get money out of my insurance company. I didn't actually here what the outcome was as I had not claimed. But assuming it all got sorted as I never had any change to my insurance policy.

The squeaky wheel gets the oil, keep on at the insurance company every week for updates. I swear they rely on complacency.

In the first instance I would’ve attempted to go direct through the third party’s insurer. They may well have denied liability and then you could’ve gone through your insurer as have done.
