Contract attached. I have worked here just over four years. Would you say the notice period is one calendar month or 4weeks?

One month. The weekly amount is what they have to give you, so yours never gets longer than a month but theirs does.

One calendar month if it’s you giving notice to them, four weeks if it’s them giving you notice to leave.

4 weeks if it’s them giving you notice, a calendar month if you’re giving them notice.

No that’s your notice from them , you have to give a calendar month clearly.

If they were to make you redundant then they would use the one week per year which is designed to protect you

My thought is that it’s unclear as they have to give 1 month notice to me up until 4 years where they only have to give 4 weeks? Why would it go down?

Your notice period to them is one month. It couldn't be clearer.

honestly that makes no sense anyway as after 2 years they can't just give you notice to leave your job so it's all irrelevant!

If we take one month to mean one calendar month (which I generally would), that means if they gave me notice after 4 months employment it would be one calendar month,but after 4 years employment only 4 weeks.

Sorry to be clear, I am the one who has handed in my notice. I took one month to mean one calendar month as anyone would. But when I saw section c it made me rethink whether it means 4 weeks if you see what I mean.

Why would it? That section clearly applies to their notice period to you.

Except your employer can't just serve you notice to leave your job, that's illegal

i just googled it - those notice periods are the statutory minimum notice period which is why it's worded that way - but they still have to follow employment law and have a valid reason to terminate employment. I really wouldn't think too much about that.

They are just quoting the legal statutory minimum notice periods for terminating employment where it's legal to do so.

You need to give a calendar month

They need to give you a month, BUT after 4 years it'll be a month plus 1week per year you've worked there up til 12 years, so total 1 month plus 8 weeks which usually gets classed as 12 weeks

I’m really struggling to see the problem , four weeks or one month, surely the difference is only three days anyway so why all the fuss or am I missing something , your notice period doesn’t alter, just there’s , increasing by one week per year to a maximum 12 weeks

Them
Year 4 is not after Y4 so they 1 month this year.

After Y4 is (start date × 4) + 1 day = Y5.
So Y5 will be 5 weeks (next year)
Y6 @ 6 weeks

ie ".... 1 additional week for every full year..."

I really, really can't see why there is any confusion over this. Your notice to them after working there for more than three months, is a month. You have worked there for more than three months so you have to give one month notice. What they have to do is irrelevant. It really couldn't be clearer.

Of course they can, if you get made redundant you get pilon so in that case you want their notice period to be longer.
