Property boundary dispute

BabyRach · 07/04/2025 14:28

We own a terraced, freehold house and for the past 8 years it has been our understanding with both prevouse neigbours that we own the fence on the left hand side of the back garden. The right side of the fence fell during the storm and the new neighbours on the right side have refused to fix it, stating that it is not their fence. It is now 6 months and we have written to them numerous times, they respond by stating that the fence is not their responsibility. AIBU by standing my ground and refusing to repair the fallen fence? Unfortunately the titles do not indicate any ownership of the boundaries.

Its my understanding is they have no obligation to actually build a fence, unless the deeds say they have to.

You cant force them to fix the fence. We share costs with our 2 neighbours. Would this be an option?

BellaVita · 07/04/2025 14:32

As far as I am aware you own the fence on the right hand side as you are looking down at your garden from the house.

We certainly own the right hand side of the fence in our garden.

If the deeds don’t state is their any indication?

your options are

leave it
share the costs
build it yourself

This is not true
In the absence of markings on the deeds then its likely a shared boundary

It doesn't actually matter who owns it, nobody is under any obligation to have a fence.
Even if its theirs and they don't want to repair or replace it then its up to them

LIZS · 07/04/2025 15:05

True that there is no obligation to have a fence. Your understanding may not be correct anyway, have you looked at your and their deeds?

QuillBill · 08/04/2025 09:34

You can’t tell whose fence is whose by what side it’s on or by you owning one on the left therefore the other one is theirs. If you want a fence, you will have to either pay for a replacement fence to be put where the old fence is, with the permission of your neighbour, or put up a fence on your own land, thus losing a part of your garden.
