Car accident insurance question

Posting for traffic .

Also posting to get info for someone else , who is very worried .

So I’m going to put the situation and any advice would help .

Driver A on the road , driving normally and correctly. Other passengers in the vehicle being transported , buisness use vehicle. Driver B comes to pull on to the road, at stop markings , wanting to turn onto the road Driver A was coming down. Driver B is a lorry so likely business insurance ( not sure ? ) . Driver B did not stop , it was obviously Driver A’s right of way . Driver B went straight into Driver A and sent the car spinning .

Driver A was Injured , as were passengers, no broken bones etc - whiplash / tissue damage . Driver A’s car is a write off. This means Driver A has massive loss of earnings and is out of work as the vehicle is his livelihood.

Driver A spoke to insurance , they have checked and there is a question on if Driver B’s insurance is even valid / legitimate company, Driver A been advised that as the car is on finance , the worth of the vehicle is less than what’s owed he would still end up in debt.

Driver A is distraught , in pain , quite traumatised and now faced with being unable to work and feels he will be in financial ruin. It seems so unfair that he has done nothing wrong and now will lose everything . Driver B did not stop when he should have and it was Driver A’s right of way.

Is there anything he can do ? Any advice on next steps ?

The immediate steps are leave it with their own insurance to investigate if there is insurance.

It there isn't there is the possibility of civil court proceedings against the driver or potentially the company and if nothing else the MIB covers some uninsured situations.

But first course is to keep on to own insurers. That's what they're there for.

You leave it with the insurers to deal with. That is what you are paying for

if B hit A B is at fault, if B is at fault and has no insurance A cannot have a courtesy car, unless A has purchased guaranteed replacement vehicle( which they should of if a car is v important to their work). The fact that the car is on finance is neither here or there for insurance as it’s the market value of the car sadly. But I know it’s unfair. Also if they cannot claim from B they will possibly loss their NCD ( i work in insurance
