Served out of date drink

Went out for a meal tonight with friends. Heavily pregnant so chose a non-alcohol Prosecco. Was half way through my glass when a friend noticed the BBE date on the bottle was 8 months out of date. Reported it to staff who were very apologetic. AIBU to take this further? Not been in this situation before!

It's a best before not a use by. Its fine and a non issue.
I imagine it's ordered so infrequently they just haven't used it fast enough and didn't realise.

What did you do about it at the time? Did you make a big fuss, and tell them you expected a free meal, or did you just let them fob you off with an apology? If it was a chain type place, then personally I would write to head office, making a point of telling them that you're pregnant, and letting them know what you want to make it right. On the other hand, if you should be ill from it, then definitely report it to Environmental Health, while copying in the restaurant.

If a private business then you should really have complained to the management/owner.

Honestly if it’s ’best Before’ and had just been opened to serve your table, I wouldn’t be bothered. As long as it smelled and tasted OK.

It's prosecco. It being a bit out of date means it might have lost a bit of it's fizz but that's it. It's not going to make you ill, especially if you got through half a glass without noticing so it couldn't have been that bad.

It's actually perfectly legal to sell food which passed it's BBD. So I am not sure how much further you can take it. You could possibly complain and hope the owner/HQ offer you something as a gesture of good will.

It’s not illegal; so there’s not too much further that you could take it.

Presumably you couldn’t taste that it was out of date either… They’ve apologised. The time to push for more than that, like a discount on the bottle/your bill etc, was then.

Tasted fine, didn’t it? As you’d presumably have checked the bottle yourself if it didn’t.

What do you want from them to make it better?

Take it further how? Are you unwell? Any other adverse effects? Pending anything significant then there’s literally nothing you can do other than complain and walk away.

Best before means just that. It won't harm you, it just might not have tasted as good as it once did. They apologised ("very apologetic", even) and presumably replaced your drink or refunded you - you didn't mention the result of your complaint at the restaurant. I'm not sure why you'd "take it further" unless they laughed and ignored you.

Crikey, yes, you must report it directly to the H&SE. There are huge risks that could arise from the bacteria that can multiply in sanitised grape juice. They may cause dreadful deformities in yiur unborn child and you may blow up like the aunt in HP and the Chamber if Secrets. Hmm

Why would you take it further. You told staff, they apologised and I assumed replaced the bottle.

It wasn't out of date. Best before is not the same as use by.

I think people get mixed up regarding BBD and Use By dates. There should be no problems consuming the former unless it's a rusty ten-year-old tin of corned beef or something.

In 2013 I worked behind a bar and did some stock rotation, found some pomegranate juice bottles that were dated 2006 Confused they were binned and other staff were given reminders about checking stock.. but 8 months is less of a worry! You've mentioned it to them so they should now be checking stock, all good.
