AIBU returning sale items bought online

I'm trying to understand my rights.

I ordered a couple of tops online.
I didn't notice on the website that the items said
'This item is final sale. no exchanges or returns'
This was very small print, same colour text and part of description.
Not clear at all & I didn't see it.
Obviously my fault - I should have looked closer.

The sizing is weird on these items & I want to return them.
Not noted to be faulty in the listing - just a sale item.

I have been looking online & I think that UK retailers must accept online returns, even for sale items.
Does anyone have any knowledge about this & my rights?

They can't opt out of distance selling regulations so they should accept returns for items bought online. Is it a UK company?

No you don't. You have 14 days to advise you want to return it and another 14 to send it back

Online, mail and phone order sales
Online, mail and telephone order customers have the right to cancel their order for a limited time even if the goods are not faulty. Sales of this kind are known as ‘distance selling’.

You must offer a refund to customers if they’ve told you within 14 days of receiving their goods that they want to cancel. They have another 14 days to return the goods once they’ve told you.
You must refund the customer within 14 days of receiving the goods back. They do not have to provide a reason.

However some brands don’t accept returns even if online if it’s final final sale. I think they might issue credit notes though…
I’ve often been put off buying for this reason

They can write what they want in their T&Cs, but in the UK, online sales have to meet UK Consumer Rights by law, so consumers have the right to return things bought online within the correct time frame.

A business can make a deduction if the item has been handled excessively e.g. more than you would when purchasing in a shop.

I wouldn't buy from a business online that had T&Cs that didn't meet UK distance selling laws.

You have 14 days to return an item bought online, no matter what their T&C's say.

I've been in this situation. I stated my rights under UK regulation but they still tried to fob me off. So I obtained my refund via PayPal. It doesn't matter what their terms are, it doesn't trump the law.
