Neighbour complaining about bins on my property

Basically my next door neighbour was having her visitors park quite frequently on my driveway on multiple occasions.

When DH was at work she would also use our drive to reverse into her own drive etc on a daily basis.

I asked her very nicely if she could stop her visitors doing this as they were parking right outside my living room window with visitors looking straight in.

It carried on happening and I moved by bins to block any more parking.

Anyway with the windy weather etc she has been concerned about the bins falling onto her car and has asked me if I would move them.

I told her it was because of her visitors being inconsiderate that the bins are the there in the first place and of course her using our drive on a daily a basis to reverse.

I have told her the bins are there for a reason and won't be moved.

Can you build a bin shed there so the bins are secure or will it block you? Either that or a pop up bollard?

I’d move the bins because DH is right, it’ll be you out of pocket if they damage her car. But put something else up, plant pots along the edge maybe?

If she damages her car when using your drive (thereby hitting your bins) I do not see how she can claim against you for it.
The bins are on your property, so she needs to be careful if she drives onto it so that, firstly, she does not damage her own car.
Further, If she hits a fence or wall on your property while driving her car, would you really be liable for any resultant damage to her car? I'd have thought she would have to pay you for any damage to your property.

It says in the OP with the recent bad weather she’s worried about the bins blowing into her car presumably as her drive is next to OPs, not because she’s still driving on OPs drive

Yes when DH gets back from work he just moves the bins.

Last week when it was very windy the bins kept getting moved we wasn't sure if it was her moving them or the wind so he got a Ringdoor bell installed.

I agree that we need a more permanent solution, as the bins are abit of an eye sore.

We defo don't want to get into any arguments with her though,

I see about you having to move the bins to get in yourselves, so heavy planters and the like won't really work then.

If there's anything out there like a collapsible bollard operated only by YOUR remote control, then that's what I'd install! No getting out to move anything, but other cars are blocked. Would something like that work, if it exists!!

We have just noticed that she keeps on of her bins right next to her car as does her neighbour on the other side.

If suggest heavy planters. They are less likely to be blown over in high winds as they are heavy and have a low centre of gravity.

The bins here blew across the street and rubbish went everywhere. It was storm force winds though if one had hit my car I'd be going after it's owner to get my car fixed.

Why risk it.

Fuck all neighbours can do about it, even if the bins belonged to the OP. The OP is not in control of the wind, its speed, strength or direction.

Get a bin shelter up so there's no risk of the bins blowing into her car. She's had her chance to refrain from taking the piss.

Tell her you will move your bins but if she or her visitors park or drive on your driveway again, you'll move them back.

I know the law does often make allowances for CFs to get their way, but where does it end? If I jumped over somebody's fence into their private back garden and used and then fell off their climbing frame, are any injuries I suffer their liability too?!

Surely the very easy solution to her not having your bins on your drive fall on to her car is for her not to drive on to your private property in the first place? She's not the postwoman or somebody else with a legitimate need to be there; just a trespasser. And does it work the other way too: is she liable for paying for repairs if her car damages your drive/property at all?

If you have the funds and the layout is suitable, I would echo PP's suggestion of gates - electric if possible. It can't be much fun for your DH having to get out of the car to move bins every night, rather than being able to just freely reverse straight on to his own driveway.

...Actually, a bollard or two that automatically lower for you only with a sensor on the dashboard is probably better. That requires much less space than opening room for gates; and it doesn't impede the postie or anybody else on foot with a genuine reason to be there.

Get some large pots and plant foliage in them they will grow quickly makes a better boundary between both your houses and not at risk of blowing around like empty bins .
She sounds like she would blame you if car gets damaged by bins.
