Injured at school

I’m a supply teacher been working in Sen v difficult class been hurt numerous times. Recently hurt in face attended hospital & had to take week off working.

Now agency have said not going back into the school - so lost out on long term work here.

Looked at agency pay & agency & school not paid me for being off at all.

any pointers on what can I do or say?

Has it been addressed at all by the agency? As in on your payslip or anything? My first step would be to speak to the agency and get an answer on why. You can go from there with tackling it. I found ACAS really useful when I had an employment dispute. Get the details first and then contact them if you need to. Just to say, as a mum of a teen with SEN, you are very much appreciated and I'm so sorry you got hurt.

When accident occurred at school first aider sent me offsite to get attended to. Was at school long term and stayed off week with the issue. Agency said “best to not go back there”and want me to go on daily supply. For days off school have not paid me nor agency at all.

injury caused by volatile pmld pupil.

I'm not sure you could do anything about the school not paying the agency, that's between them. Your agency is your employer, not the school. When I was agency there was an additional sum took from my wages to cover insurance for incidents like this so that I would still be paid. I had to opt-in, it wasn't automatic. Look into your contract with your agency but unless you were paying the insurance or there is something written in the contract to state you would be paid when incidents like this arise then I don't think there's much you can do. It's a risk that comes with doing agency work.

Would your agency usually pay sick pay?

I’m not sure why you’d expect the school to pay you. They are not your employer.

Thank you all for your kind responses.

Basically not been paid a penny whilst being off injured.

The agency or the school have decided I’m not going back to the school (can’t really get to the bottom of this) as this isn’t the first assault I’ve had 7 since December one being headbutted in the face but I stayed in school.

so now I’m on day to day supply work which is abysmal and soul destroying - but that’s another rant 😀

I don’t work in this field.
but I do think it’s pretty awful that you can get injured at work, to the degree that you attend hospital and have to take a week off, and don’t get paid.
I don’t think it’s unreasonable of you to expect support at this time, as you are not “off sick”
do you have documentation to prove the extent of your injury?
surely this isn’t acceptable.

Yes : full documentation from the Eye Hospital in respect to a severe eye trauma.

letter arrived from hospital with all details of medical procedure & issues I presented with.

still suffering but treatment working.

no pay & agency really not interested.
