Penalty charge notice dispute

Has anyone successfully disputed a traffic fine that was in fact the person delivering a new car on the way to their home?

This is the second time it happens to me, the first time I disputed it and attached an email exchange between me and the dealership confirming the delivery time to me was 6 pm and the alleged offence was at 4.10 pm before I received the vehicle. No luck….

It’s happened again (!) but this time with another dealership and I wonder if there's any point to bother disputing it and getting frustrated through the process.

I contacted the dealership but didn’t bother to reply.

YABU - pay the fine and forget about it

YANBU - dispute it with both the dealership and the issuing council

I would definitely dispute that. With ticket, and also dealership. Are dealership trying to fobb you off aswell?

It's not just the fine, it's point on your license too. Unless it's a parking fine you are disputing.

That's appalling OP, how can they have made you pay the fine the first time, when you were able to prove it wasn't you driving? There's no way I would have paid it. Also, do you have anyone who can confirm that you were elsewhere when the second fine was issued, ie, were you at work, when the car was on the road?

I'd defo be disputing that. I'd be continuing to contact the delivery company and get it sorted. There must be proof out there. Shocking that has happened not once but twice.

You need to ask the car company for a copy of the log of drivers. They must know who was where and who was driving what

Of all the things to appeal, not yet being in possession of the car at the time of the offense seems a pretty straightforward one

My partner got about 6 parking fines over an Easter weekend. It was at a garage for a new engine at the time. They had disposed of the original tickets and the first we knew about it was the reminders. Dropping through the letterbox

The council cancelled all but one as a goodwill gesture but on appeal we were still found liable as registered keepers...

Is there an option to name the driver on the form if it wasn't the owner?

I have an email chain from the dealership confirming the car will arrive at 5.10 pm and the traffic violation took place at 4.15 pm in another borough.

I worry this will be the case for me. The car was delivered at 5 pm on a Friday and I was named as the registered owner earlier that day. I’ll submit an appeal anyway and see how it goes.
I have an email exchange with the dealer confirming the car was due to arrive just after 5 pm and the traffic offence took place an hour earlier in another borough.

They are not responding to my emails. I know the driver’s first name and will find a way to get his surname to add to the appeal.
I’ll also leave them a review on Trust Pilot to warn others of how unprofessional they are.
