Resident Parent Leaving The Country

After a lengthy court battle for the other parent to gain custody of our child to live with them, they have decided they will be working abroad during the week!

During court they painted themselves to be the doting parent who would be there for all child's needs during the GCSE period and beyond.

I am currently experiencing mixed feelings and need to make sense of it all before discussing with the other parent!

They promised to be there for the child in the evenings and overnight and will now be away Mon-Fri leaving child with their partner. This person has no legal responsibility for our child.

I will be the only person in the country with parental responsibility for the child and I am at a loss on how to proceed with the conversation. Surely with a Child Arrangement Order in place setting out his responsibilities he needs to be present to fulfil them?

How long ago was court? If DC is doing GCSE’s then surely they have a say in where they live at that age?

Potentially, but now they are in year 10 I would not want the upheaval and disruption of moving school again, and I doubt a court can order the other parent to stay in the country for work?

Court ended about 6 months ago, child decided to live with the other parent given all the promises presented to them.

Why was there a lengthy court battle over a teenager? Why did the court not listen to the child and avoid all this process?

Speak to your solicitor but given the child’s age surely they can decide where they want to live now given the change in circumstances?

As the child is 14/15 can't they decide where to live?

Talk to your teen and ask them what they would like to do. It's up to them now.

The courts are very backed up at the moment. Due to all the safeguarding concerns and other factors such as distance and siblings it took longer than it should. OP changed their lifestyle to make it look more appealing, but at the end of the day a leopard never changes it spots and unfortunately our child is now bearing the consequences.

Ask your child where they would prefer to live during the week, with you or their DF's partner?

Your ex doesn't get to have DC every weekend and all the holidays because they are away all week every week though, make sure you still get half of these.
