Asked to do course in work time but likely to not get paid

I work in childcare and have done for a long time. I'm going on a course next month and it takes place on days I'd normally be at work. I asked if I'd get paid because the course is directly related to work. It's looking like I won't be - is this unusual? I've not come across this issue before.

I'm not in a union with this job.

YABU - no you wouldn't get paid

YANBU - they're being cheeky and I should be paid.

You need to check what your contract says.

Unfortunately employers are allowed to send you on unpaid mandatory training if this is stated in your contract, as long as this would not result in you being paid less than NMW over the whole of your hours.

If you work 16 hours, can you swap your days so that you can attend the course and work your normal hours? Although I believe it's usual for work to pay you when you are attending courses that they want you on, I would just do the course from your own time. I think that it is legal for them not to pay you. I personally have done a 2 days course on my own time for my previous employer. I would not make a fuss over this since it's a one off and I wouldn't want to be first in line if redundancies come onto the scene. Lots happening right now. My sibling has just been given notice of a redundancy exercise so it's in the front of my mind.

Ask for a copy. By law you are entitled to at least a 'written statement of employment particulars' which should include the main terms of your employment including hours and pay.

Regardless of what the contract says, if the unpaid training takes you below NMW they can't make you do it so it's worth working that out as well.

Ask in writing to confirm that you will be paid as normal for your work hours on those days.

I would definitely have assumed I'd be paid as normal. I highly doubt you need to worry about redundancy in childcare at the moment!

If it's your normal working days and you won't be being paid otherwise, yes, they definitely need to pay

You need a copy of your contract regardless and while you're at it a copy of the employee handbook.

Have you had all the right db's checks?

They sound shady regardless, especially if they don't pay you for mandatory training, so I'd start looking elsewhere....
