Who should sort this fence out?!

Fence between myself and our neighbours back garden has come down in the storm. It’s a very long fence ( gardens are a few acres).

Normally I would agree to 50/50 but in the summer we got a quote to change the fence. It’s currently only 4th high and we wanted more privacy. We were happy to replace with a 6ft fence but the neighbour stopped us. Said we couldn’t change it as it was his fence and he didn’t want to change it. So we left it at that.

Would you take that as his responsibility to fix??

Sounds like it's his fence (do you have it in writing that he said it was). Either way I don't think you can make someone replace it.

There’s no requirement to have a fence to mark a boundary, so if he’s not interested in repairing or replacing his fence that’s up to him. If you want a taller fence and he doesn’t want you meddling with his, put one up on your side of the boundary, in front of his.

He said it was his fence so let him fix it at his cost, if you want to put up a 6ft fence for privacy you can do that on your land.

Poor neighbour! I bet he is regretting saying that now, and is staring out of his window wondering how he is going to get round you! Bless!!!!

He does want to fix it as he has 6 large dogs. We don’t have any so we’re in no rush.

he’s out there at the moment haven’t a look so hopefully will sort it himself 🤞🏻

If he has dogs then I don’t think he was particularly unreasonable in the first place to prevent you changing the fence, because it would then become your property and that then leaves him reliant on you for any repairs or maintenance - just as you’re currently reliant on him to fix the broken panels. We own the fence which separates us from our neighbours, and I wouldn’t agree to them taking our fence down and replacing it with something of their choice, either. I wouldn’t want to have to wait for them to fix it on their own time when we have ducks to keep in.

Hopefully they’ll have a similar attitude and fix the fence asap. I don’t fancy a XL bully wandering around my garden 🤦🏻‍♀️😂

I'd just put my own 6ft fence up a couple of inches my side of the boundary if the alternative was an XL bully in my garden 🤷‍♀️

You’ve only got a 4ft fence between you and an XL bully?! Nah, I’d be upgrading it asap.

I mean he could just chicken wire the whole thing to keep his dogs in. Personally I’d put my own up just inside my boundary. Especially since it’s XLs

Unfortunately we can’t erect a fence inside our boundary. We have trees that have a protection order on them 🤷🏻‍♀️. So it’s the boundary of nothing.

If you want a higher fence I'd pay 50% to get what you want. If the neighbour says no then they should pay the full amount as it's their fence. In my home we are each responsible for one fence, so the fence to the right we pay for in full, the fence to the left the neighbour pays for in full. There has never been any discussion about sharing costs.
