Is this a breech of my Data?

patsy999 · 04/11/2024 07:52

My carer got a lift to mine from a male friend of hers, last night to do her call.
So she had to give him my address.
Feel a bit uneasy now, about some random male knowing where i live.

OP posts:

Interesting question, address is considered as personal data under gdpr, not sure if giving someone a lift eg via a taxi would be considered outside the scope of legal basis or legitimate interest

One for a data privacy professional, am sure there are a few on here

TinyBlueHoe · 04/11/2024 08:00

No it's not.

Unless she also gave him a run down of all your information, like name, date of birth, etc. Which I doubt!

KrisAkabusi · 04/11/2024 08:01

Did you meet him? As if not, he's not associating "you" with your address. It's just a random house that he dropped a friend to and he doesn't know "your" address, if you see what I mean.

Sethera · 04/11/2024 08:01

No, it isn't a breach - otherwise everyone who ever took a taxi to someone's private address would potentially be in breach too.

Your name and address are in the public domain in the form of the electoral register. You can redact them from the freely available version, but you are still searchable on the full version if anyone really wants to find you.

What is your specific fear relating to a random man knowing your address?

ETR 'pay for' - you don't pay to redact them, of course - Monday morning brain.

Sweetsweettoot · 04/11/2024 08:03

Maybe she didn't tell him the full details, exact address, who or why she was visiting (can you drop me off halfway down Duck Street so I can visit my friend).

Do you have any reason to distrust her or the man? If not then I don't see the issue, lots of random men know your address.

BeMintBee · 04/11/2024 08:05

Any random male could know where you live by virtue of the fact they could walk past your house and see you living there?

Catza · 04/11/2024 08:05

Your address is only identifiable information when it is linked to your name. Arguably, every "random man" who passed your house knows your address. What do you think your carer's friend might do?

SnoopysHoose · 04/11/2024 08:06

Do you think the same if she gets a taxi? you're being silly

FfsBrian · 04/11/2024 08:07

It IS but I doubt you’d reach the threshold for a claim.

The carer would have also had to tell them your name.

You would have to prove that it identifies YOU personally.

As in - ‘Sandy Jones’ - could be any sandy jones. And your address alone could be anyone’s address. BUT Sandy Jones who lives at xxxxx identifies YOU personally.

Have a look at the ICO website.

But how else could they have got to you if they didn’t have a car?

MikeRafone · 04/11/2024 08:07

It’s not a breech of data

the man could walk into any council office and look at the full election register of names and address, it’s a public open document.

SilverPuffin · 04/11/2024 08:08

Did she tell him your name ‘please drop me at this address where I’m going to see first name last name’ or just asked to be dropped at an address (yours)? There’s no breach with the latter, it’s just an address which anyone could know just by dint of walking past.

I came here to say this.

As long as she didn't give friend any other info, you're good. It takes more than one piece of personal info to actually identify an individual.

tuvamoodyson · 04/11/2024 08:11

Hardly…

DirlingWhervish · 04/11/2024 08:16

Agree with others, I doubt very much the carer would have given your full name, which might have been a breach, but otherwise not. But as it's obviously made you feel uncomfortable, check with them and let them know.

BabyCloud · 04/11/2024 08:23

When I worked in the community years ago one of the carers had her son meeting her countless times throughout the day to drive to certain addresses.
I think he knew them all by heart but he didn’t seem to give them a second thought. He was just giving his mum a lift.

It’s dark in the evenings. I’d be happy she wasn’t out walking alone potentially late at night. Some of our last calls were around 11pm.

KindQuail · 04/11/2024 09:51

Unless she gave the driver your name or other identifiable information then no.

DogInATent · 04/11/2024 10:13

A minimum of two data points are required for it to be GDPR issue, your address on its own is only one.

It's no different to if she used a taxi.

TheLimeHedgehog · 04/11/2024 10:15

OP do you also ask your careers what they do with the footage from their dashcams' in their cars also?

Who knows who has access to that video with your address on? Especially mechanics and dodgy garages that might get their hands on your specially secret address, thieves might even steal the dashcams and discover where you live?

Honestly you sound like your just looking for reasons to destroy someone's career.

SerendipityJane · 04/11/2024 10:23

Your name and address are in the public domain in the form of the electoral register.

Only if you are eligible to vote.

If the subject is registered to vote. You won't find many foreign nationals in there.

No - people can visit the council office and view the full register - including people who have elected (see what I did there 😀) not to make their details public.

It can be a faff - I've had to do a few times. Expect a full day.

😂exactly!

MartinCrieffsLemon · 04/11/2024 11:32

Would you feel the same about the taxi driver? A female friend? It being her son?

marmaladeandpeanutbutter · 04/11/2024 11:43

No it probably isn't.

Not meaning to be a twat, but it is breach. Breech as in breech birth; breach as in data breach.
