So annoyed…parking eye

Hi

Recently I parked in an underground car park. The parking charge could either be paid in cash or via the ring go app. I had no cash so did the ticket on ring go. As it was underground the purchase wouldn’t go through so I went upstairs and got signal and paid.

I then got a fine from parking eye as my ticket didn’t cover the whole time (the ten minutes it took to try and pay twice and then give up, run up the stairs and pay). I appealed it but they denied this. They didn’t tell me they had denied it by post and instead an email which I’ve just searched for and found in my junk folder.
I got a letter today saying I’ve lost my right to go to pools for this and now owe £175!!
how are they allowed to do this? It’s sounds ridiculously harsh as I did buy a ticket. Any CCTV they had would show me trying to pay then going upstairs to pay.
What can I do about this?

That's terrible, but I'd just write it off as part of the costs of running a car

My reaction would simply be. "I owe you nothing, take me to court".

No debt can be enforced until they have a court judgment.

If they continue to try to get the money from you simply reply "Take me to court".

So many people simply give in. There is a risk - of course - that you could lose and get charged more. Court is fun though@Cupofteaandbiscuits

I would just pay. Every time you argue, costs are added.

I’d always just pay and put it down to experience. I get that they win if everyone does it, but I wouldn’t want to face a mounting debt and have the hassle of dealing with court proceedings. Of course, it might not come to that but I’d rather just not even go there.

No, I'd go to court as what you did was reasonable

The clue is in the name, underground car park and the fact they gave you a choice to pay via the app

Going upstairs to where signal is is a perfectly reasonable thing to do.

You don't get the option to backdate the time so it's not your fault

How is court fun @Thelittleweasel ? May have to go soon with my son re him forgetting to renew a rail card 🙄, any positives to it would be good to hear

My husband went to court over a Parking Eye fine that was unfair. They didn't turn up and the judge found in his favour.

We have had a 'fine' from them in the past, ignored all communication and they eventually stopped bothering. It was several years ago and we haven't been taken to court yet.

Be careful - I appealed and appealed and won and they gave me a CCJ anyway but I did not know until 3 years later when I could not get a new bank account and checked my credit rating thru Martin Lewis' app. Experian did not show the judgement and my credit rating on there was 999. I had to make another appeal to remove the CCJ which restarted the parking fine and I have just paid it now because I felt I was going to have a breakdown. I was absolutely in the right - it was a blue badge issue - but they fucked me over good and proper and with malice.

Check your credit rating thoroughly
