AIBU or is the landord responsible for this washing machine?

We moved into our private rental 18 months ago. In the kitchen there is a washing machine that is fitted in to look like a kitchen cabinet (it's basically inside a cupboard that looks like all of the other units in the kitchen and has fittings on it so the door actually closes and stays shut) At the weekend the washing machine has broken, it looks like the actual drum has come lose and dropped. We reported it to the agency yesterday, today the landlord has contacted us directly to say that they did not provide the washing machine and that the previous tennant left it so we need to replace it.

I really don't think this is the case and that if the appliance is provided with the house then it's their problem. Can anyone provide any advice?

AIBU - No, it's up to you to fix it.

YANBU - They should be fixing it

what was listed in your tenancy agreement ? That will be the key - does it state that a washing machine was being provided ?

is it on your inventory?

if so it’s the landlord’s responsibility. If not it’s yours.

At best, the landlord has mixed up two properties and has made a mistake about the washing machine.
At worst, they’re trying it on. If it’s an integrated appliance then there is no way that the previous tenant also fitted the kitchen too.

tags a photo and send it back to the agency and tell them its the landlord’s responsibility to fix / replace

It's possible it isn't on the inventory, in which case it would be your responsibility.

However, if it's integrated and the previous tenants left it there, it sounds like landlord is trying it on.

If you do replace, remember to take it when you leave!

Like others have said it depends on whether it was on the inventory. If not then you can buy one and take it with you with no need to replace!

If it is a built in integrated washing machine it is extremely unlikely the previous tenants fitted it. For a start they are more expensive to buy and fit.

As another poster said, check your inventory, if it is on there it should be a landlord fix.

It may be on the inventory but still be the tenants responsibility to replace, it depends what it says on the contract.

My previous tenants left a pretty new washing machine when they left, the new incoming tenants were asked if they wanted it or wanted it removing and it was written into the contract that they could have it but if it broke it would be up to them to replace. Everything else in there, oven, fridge, freezer and dishwasher are all my responsibility as a landlord.

If it's on the inventory and it says nothing regarding it's use/replacement then the responsibility is on the landlord to replace when it breaks, I would also argue that if it is integrated like this is, you couldn't necessarily take it with you so it's unfair of the landlord to make you replace it from your own pocket.

My understanding of this is that if there is a working washing machine in the flat when you move in, then the landlord is responsible for it.
When I left a property in the past I asked if I could leave my washing machine behind. The landlord told me that I had to get a written agreement from the new tenant that they wanted it, and that they would be responsible for it, as the default position would be that the landlord would be responsible for it otherwise.

I am a landlord and rented my house with a dishwasher that was working but I didn't want. I specifically said they could have it and use it but I wouldn't be repairing it if it broke.

Anything that was in the property when you moved in is the landlords responsibility to fix/replace. It’s not your responsibility. It doesn’t belong to you. I used to work in this field. Don't let the landlord try to pass it off
