Fraud clarification

I won’t go into detail but basically an online shop has taken £500 from my bank account from an order someone managed to place through my account. I don’t know how my account was accessed, I haven’t given away any details, etc. the order also isn’t coming to my address. When I called the shop they opened up a claim but then closed it on the basis of ‘no evidence’. I’ve since called back and they’ve reopened the claim, but my money is still gone.
My bank have refunded me £500 as part of their services, but the actual shop hasn’t refunded me. How exactly does this work? Do I send my bank company the £500 back once (if) the online shop refunds me? What happens if the online shop still decline my fraud claim?
I’m so stressed. I want the £500 back from the online shop. I’m worried I’ll end up having to pay back my bank company as well as NOT get my £500 back from the online shop. I can’t afford this as then I’ve essentially lost £1000.
I’ve wept nearly all day from the stress

If you’ve raised it with your Bank then it’s up to them to investigate - they’ll either let you keep the money as they’ll claim it back from the company, or they’ll take back the money and not uphold your dispute. I doubt the company will refund you directly as they sound like they don’t want to deal with this.

If it is genuinely fraud, which it sounds like it is and the fact it’s going to a different address is a good thing, you will most likely get your money back through your bank. If they don’t refund you then take it to the ombudsman.

you won’t end up out of pocket by £1000 so don’t worry.

Notsureinlife · 09/10/2024 20:07

If the bank has refunded you, they are now the "victim" as they are now the ones out of pocket although it is very unlikely they will pursue the £500 from the online shopping company.
Contact the company and explain that you have now been refunded by the bank so they can close their case although I would maybe see if they can set up a password or some other security function to prevent any one but you purchasing in the future.

If your bank has refunded you then that's the end of it. It's up your them to take it up with the shop.

DoYouReally · 09/10/2024 20:14

It's over for you. You now have your money back.

The bank would not have refunded you until they were satisfied that it was a fraud case.

The bank will continue to do their investigation on the background. They won't advise you of the outcome as (1) you already have your refund and (2) they'll never share how they shut down fraudsters and eliminate the ways on which they can stop it happening again.

You can stop stressing. You have your money back and it's over.

Kitkat1523 · 09/10/2024 20:16

It’s over for you OP…..if your bank wish to peruse that’s down to them….very unlikely they will
glad it turned out ok for you

HundredMilesAnHour · 09/10/2024 20:18

Your bank has refunded you already. You want the 'online shop' to refund you as well so you double your money and make 100% profit? That's not how it works. Accept the bank's refund, move on.

And if you're the "Vinted fraud" poster who flounced a few mins ago, you really need to get over it. I write that respectfully, of course.😉

Valid8me · 09/10/2024 20:20

I understand it must be stressful but I don't get the weeping all day. You haven't currently lost anything as your bank have refunded you. You can't expect the online shop to refund you as well but if they do, you give it back to the bank.

Woahtherehoney · 09/10/2024 20:21

All the posters saying it’s over isn’t necessarily true - this is a fraud case, not a scam case. I’d imagine this has been raised as a non plastic fraud case (unless it was taken through your debit card) - so what they’ve given you is most likely a pre-credit which they can take back if they investigate and find you at fault.

I’m not saying that to worry you OP, just so you know what to expect. To me this sounds very clearly like fraud so I imagine this is it for you but worth keeping in touch with your Bank just in case.

MissEloiseBridgerton · 09/10/2024 20:27

I don't understand why you think you'll have to pay your bank back? They have refunded you as you told them it was fraud. End of story.

You may want to change all your passwords.

I don’t want double the money, I want to know how the process works regarding if I need to pay back the bank as this is a new situation for me. I’m currently only spending money if I absolutely have to just incase I have to pay the bank back. I also have no idea what the Vinted thing you’re referring to is either. Maybe ask for clarification instead of jumping straight to an accusation.

This is the issue I find with this site. You can never ask a question or make a post without at least someone trying to stir the pot.

If you can’t answer my question to provide the help I’ve asked for then you should bore off. I write that respectfully, of course.

Because the shop are trying to claim that I placed the order when I didn’t. The bank have lent me the money on the basis that I didn’t place the order. I’m stressed I’ll not get the money back from the shop and will then also need to pay my bank back, making me £1000 out of pocket, if the online shop fail to take me seriously.
Currently on maternity leave so money is very tight and hormones are all over the shop. I don’t need this, hence the weeping. We all cope with stress differently

Because the shop are trying to claim that I did place the order and are trying to dispute that it’s not fraud. My bank have given me the money on the basis that it is fraud. I’m worried that the shop will somehow convince my bank otherwise, meaning I’ll need to pay them back. I struggle with anxiety so my head jumps to the worst case scenario in everything.

I’ve changed all passwords and cancelled my card

You are not £1000 down. As it stand-a you are back to the position before you were defrauded. If the bank claims from the shop it gets reimbursed he money they have given you. Did the shop send the goods to the other address or did you cancel in time?

They’ve sent the goods to the other address, and have also sent me an email to say that they’re disputing the case as they don’t believe it’s fraud.

I’m stressed I’ll not get the money back from the shop and will then also need to pay my bank back, making me £1000 out of pocket

You started off £500 down.
Your bank have credited you, you're currently £0 down.
If the bank take the refund back you'll be back to being £500 down.

There's no scenario here where you end up £1000 down.

You’re right, I wasn’t thinking clearly with the maths/numbers as I’ve been so stressed with it all. I’m a naturally anxious person so my head usually goes to worst case scenario in situations I find stressful. Thank you for your explanation

The bank have refunded, they raise a chargeback with visa or Mastercard. They get the money from them. They then go to the merchant to get their money back, if the merchant disputes they need to provide evidence that you actually made the transaction
Lots of banks will still cover you for a fraudulent transaction, even if a merchant is successful

Stop stressing

LoftLaughLoads · 09/10/2024 22:50

Huh? You have got your money back from the bank. You no longer have any correspondence with the shop. It is none of your business and of course you shouldn't have a second refund.

The bank has accepted your word that the money was taken in error and has reversed the transaction. The have taken the money back from the shop. It's up to the shop now to report the crime to the police of either the recipient of the goods for theft by deception or to report you for fraud - depending on whether they have more evidence of one or the other.
