Posting for further advice:

Moved house early 2022 and scrapped car summer 2022. Failed to notify DVLA of both situations (wasn't aware of this at the time, but of course not an excuse).

Fixed Penalty notice received for driving without insurance end of 2022. I did not receive this due to the change of address and car had been scrapped anyway.

Further Steps notice received for almost £500 at new address. I took the option of going to court for statutory declaration as I wasn't aware of the initial fine.

I've now been given a court date but I'm not sure what to do.

Can anyone advice what my options are and what the potential outcomes for all scenarios could be please?

Is there a better option I should be going for?

I'm guessing the scrap company sold the car on, but because I hadn't notified DVLA, my address was still on their system for the car.

The first I knew about the issue was the fine for £500 from the court. So I rang them and they explained what it was about and gave me the option for Stat Declaration. Its only now I'm thinking it might not actually be a good idea. 😕

That makes far more sense.

Did you not fill in the VC5 logbook thing when you scrapped the car?

Court is your best option.
I'd take the evidence that the car was sold to a scrap company (copy of payment, receipt etc...) then I'd also say you forgot to update the address as you were scrapping the car. Go dressed smartly and be apologetic but factual.

Even if the scrap company sold the car on or used it themselves, why did you get the fine? Why were you still the registered keeper?

Because OP never updated DVLA of change of ownership- the fine for which is £1000

That's exactly the point of my post - I unfortunately did not notify DVLA of the scrap.

I can evidence the fact that the car was scrapped before the incident date (Bank statement, email). I just don't want to risk another charge then being brought I.e. failure to notify DVLA, which kind mumsnetters have said is likely not to happen. So fingers 🤞.

I'll update once this is all over.

Update - Incase anyone else finds themselves in this situation, statutory declaration was successful and I was given a court date next year. However, I have now been offered an out of court settlement of £50 to close the matter.
