I genuinely would like opinions - what does the definition of "new" condition cover on ebay?

I think paypal expect you to give them a chance to respond. I would write to them tomorrow if they don't get back to you on the email you've already sent and say that you will open a dispute if you haven't heard from them in 3 days. Or longer if you prefer but I would give them a defined period of time that is at least 48 hours personally.

Alternatively you can request other contact details like phone numbers from ebay. I prefer to do it all by email (and through ebay so there is a record) so that everything is in writing.

Well, you've now got an email from him saying he'll give you a refund, so if he didn't do it you'd be able to send it to eBay with your complaint. I'd go for it personally, but probably send it as "to be signed for" so you know it arrived ok.

hmm, I smell a rat - not with op - if she sends it back seller may now try to claim she has used it. I would raise with ebay/paypal as a precaution and tell seller that when received it appeared used, you have not used it.

I woouldn't send it back until you have the refund, as the seller is still claiming it's new I would be very wary.

If you do send it back you could take some photos of it first with a newspaper or something else with the date on next to it maybe? Then at least you have some proof as to what condition the item was in when you returned it.

Have to say that I don't think you can demand a refund before posting it back. As a seller there is no way I would ever agree to this!

Think going through paypal is a good idea though as at least it is then on record that you have told the seller about the probelm. As long as it gets resolved amicably then it will make no difference to seller.

Other thing is that they may be genuine - if they are a new seller they will not want to risk your bad feedback so actually might be more inclined to be helpful than someone who has thousands of feedback and for whom a single neg will make no real difference. I might be just looking on the positive side though !!!

Oh and don't worry about ending up with no pump and no money. Send it back recorded delivery (probably have to be special delivery to insure it for £65) so you can prove to paypal you have sent it back and they will back you up in a dispute for sure. They very much favour the buyers in situations like this so I don't think you actually have much to worry about. Just make sure you have proof of the condition the item is in and proof that you have returned it.
