To ask for a rent reduction?

Long story short - I was away last weekend, returned home on Monday but stayed at DP's. Tuesday morning I went home and there were around 30 dead wasps on my stairs and hallway - I looked and noticed that there was a small hole where the window fascia meets the brickwork and the wasps were entering and leaving through here. I looked outside and they have dug through the mortar and have built a nest in the wall cavity.
I alerted my landlady on Tuesday, she said she was away but would get someone out. Thursday comes and I've heard nothing, I have a 4yo so we have been stayed at DP's as the house is absolutely swarming with wasps, so I chased landlady. Pest control called me Friday at 4pm, saying they would be out Monday.
They arrived today, and have told me that they have put a powder in the cavity which should kill them, and then the mortar needs to be filled in. We cannot go back to the house for 24 hours, and when we do, there will still be a few wasps coming in and out up to a couple of days after. By 7 days, if there are still wasps, pest control need to return.

So, AIBU, to ask landlady for a reduction on Augusts rent, in lieu of the fact I've already been out of the house for a week and could be for a week or so more?

What does the landlady say about you having to be out of the house for 24hours? I had something similar and my landlords insurance paid for me to stay in a hotel for a couple of days.

FlangeBoil · 29/07/2024 13:38

@MyBreezyPombear she's not really said anything. She knows we can stay at my partners so assume she hasn't really thought about it!

This is for repair works, which is kind of what it is and this is what it says on Shelters website:

Alternative accommodation during repair works
The tenant might have to move out of the property temporarily while the landlord completes repair works. For example, where the repairs require significant structural work or when the repairs means the tenant cannot stay where they are.
Most private landlords do not have an obligation to provide the tenant with alternative accommodation, but the tenant could ask for somewhere else to stay. A landlord's insurance might cover the costs of a short stay in a hotel or bed and breakfast.
The tenancy agreement might state that the landlord will arrange alternative accommodation in some circumstances. For example where all or part of the property is unfit for habitation.
The landlord and tenant can agree to suspend rent payments if the landlord needs access to the entire property or there is a reason why the repairs cannot be done with the tenant present. The tenant should ask the landlord to confirm any agreement in writing.
A tenant should continue to pay their rent unless the landlord agrees to a rent reduction in writing.

I think the only thing you can really do is speak to your landlady

Who said you needed to be out for 24hrs? I had a wasps nest in a wall treated in a similar way and we didn’t need to not be there?

FlangeBoil · 29/07/2024 14:03

@MyBreezyPombear thank you, I also think it may be a case of simply asking.

@Changingplace pest control - they've said 24hrs before we return and then there may still be some wasps in the house.

You had a nest but was your house swarming?

This was an hour after I cleared up when I popped in on Saturday to collect some things for the week. No idea why some are dying, but there was probably about 15 at the top of the window, very much alive.

If you can stay at your partners then fair enough. Most people don't have that option so would have stayed at home, I've lived through more than one wasp and maggot infestation, I don't rent though so had to fix the problem myself.

dontcryformeargentina · 29/07/2024 18:26

I would. Ask her politely - 50/50 chance she will say yes.

Wafflefudge · 29/07/2024 18:51

I've had a waso nest but we didn't move out just closed that door and blocked gaps in door while sorting so I'm not sure most people would expect you to move out. I don't think landlords have to accommodate you anyway and if you have somewhere to stay im not sure it's called for.

FlangeBoil · 29/07/2024 19:53

@Wafflefudge I agree, however the window is on the landing so you have to pass it to get up and down the stairs. I'm keeping the upstairs doors closed but the downstairs area is open plan so there's no real way of containing them unfortunately which is why we aren't staying there whilst things are so rife

I don't think you should, you've not incurred any extra costs by leaving and all your stuff is still safe in the house. Plus the landlord did sort put a fairly quick response - a week between you letting them know and hopefully the problem being sorted.
