To want some kind of redress - leak coming through the roof for 9 months

Any leasehold flat owners or property managing agents out there? Help!!!!!!

I live in a leasehold flat. There is a landlord, a residents' management company (RMC) and a managing agent for the block that I live in.

My flat is partially covered by the roof of the whole block and partially by the decking area of the flat above me.

I have had a leak coming into one of my bedrooms for 9 months now and it has turned into some kind of nightmare trying to get it resolved.

In October of last year I reported it to the managing agent. They sent a builder out in early November. He told them what needed doing. I heard nothing for two months and in January I picked up the process and asked the managing agents what was happening. Silence for a week or two and then they said that the resident above me, whose deck goes out over part of my roof was saying that they didn't want any work done without a surveyor approving it. It looked as though part of the repair work would have to be done on her decking, as well as the roof.

To cut a very, very long story short, the resident above me is uncooperative, the managing agents lack authority and the directors of the RMC are scared of the resident above me.

I am so pissed off, as I want to move house but I can't with water coming through the ceiling. I've read the lease, read the guidance on the legal responsibilities of the RMC and done all the research I can, all of which leads me to believe that 9 months of inaction is unreasonable and that the RMC and the managing agent have a responsibility to repair the structure of the building in a timely way. However, I don't know how to get this enforced.

Am I being unreasonable? Is this normal? Does anyone know if I can go to some kind of ombudsman or even the landlord to complain? I just want the wretched leak stopped, my ceiling redecorated and then to sell up.

I think you’re going to need legal advice on this. Maybe start by calling Citizens’ Advice and see what they say?
