NMW for 16 year olds

Hi

My 16 year old DS has just started his first summer part-time job before he started his A-Levels and was paid cash for his first shift (6 hours) The pay worked out at 4.58 an hour. He hadn't discussed the pay amount with them

Am I correct in thinking that NMW should be 6.40 for a 16 year old even for a part-time summer job? Just wanted to make sure before he or I query it

Did they make him take an unpaid break perhaps?

Yes that is pretty rubbish. My 15 yo is pot washing at a cafe once a week. She gets £30 for 4hrs so £7.50 p/h and then gets a share of tips.

Actually ignore my previous post. He has only been paid for 4.3 hours at £6.40.

I would get him to query it first. Then definitely take it further, even if it causes problems, it will stop them exploiting other young people.

Break will be unpaid I expect.
Has he been mistakenly taxed.

Thanks for the replies - he was there 6.5 hours and got a half-hour break so I'm assuming that was unpaid so I've worked out rate based on 6 hours.

He's back in on Thurs so I think he'll have to query it not being at least 6.40 although he'll find it hard to do. No contract yet

My DS started work last summer at 16. He had a contract straight away. I'd get your DS to ask for that because then all the information will be on it in black and white.

There is a real range of pay at that age - from minimum wage up to £12 plus an hour.

Where my daughter works now pays £12.50 ish - they haven't recruited since last summer (apart from Xmas temps) - they pay well, treat them well and keep their staff.

The place her friend worked paid 16yo minimum wage so £5.50 ish (last year)and both her friend and the guy that start at the same time were gone within 3 months (also treated badly)

He could just politely suggest that he's been paid what he assumes is the rate for 15 year olds (no NMW) and that in fact he is 16 now so should be paid £6.40.

Yes I think that could be the best way to approach it tactfully.
