I’ve been in my job for a year, I left a position I’d been in for 6 years for this position and it’s nothing it was promised at interview. No funding, lots of issues- management not great and lots of late nights and travel that wasn’t previously mentioned.

Due to this, I’ve had around 8 weeks off sick with mental health (Anxiety)and stress. I spoke to occupational health who also agreed I should be off for a little while it should be classed as “disability leave”. I declared mental health at interview because I had suffered for around 12 years. My work has always been up to scratch and no disciplinary or warnings.

I recently interviewed for a new job and got it! Reduced hours to what I’m on now and a less stressful position. I gave my manager a heads up I was leaving as she was about to purchase plane tickets for events later in the year, but told her I wouldn’t be putting my official notice in until references were in or if signed a contract.

Each day that followed was her asking me each day to submit my notice, I’d say not yet and she would ignore me. She started to kick me out of meetings and not include me in the weekly tasks even though I was still an employee. Eventually she said to me that she had submitted it for me to HR.

I then, get a notice from my new job that my disability (sick) leave had been included on my reference from my manager and that it was past the trigger point of days they allow in referencing. I tried explaining it was disability leave but this didn’t seem to help. She said she would speak to the hiring manager and get back to me.

Now, I don’t know what to do. I’m waiting to hear but so worried they’ll retract the job and I won’t be able to pay my bills. I’m also wondering if they were even allowed to mention disability leave as Google says it’s a big no.

What are you looking to take further - the fact that your number of absences was given on the reference?

They can do this.

@Ereyraa You cannot actually include sickness reference if it’s related to disability- it’s against the law.

Can I pursue this further?
