DD was pushing on a sports day run - multiple fractures - AIBU to considering suing ?

DD is sporty, on running on school sports day, another girl came running from behind and pushed. DD took a tumble, went to A&E, had multiple fracture to right arm, could be semi permanent change as a result of this incident. Now the other girl or their parent failed to care or consider saying sorry, had the audacity to talk to other mums implying DD was at fault being slow !! and the school was nincompoop.

AIBU to consider legal action against the other parent or the paid for school ?

It's not the schools fault and if you want to sue the parents, you will need solid proof that the other girl pushed your daughter .

I wouldn’t sue, but I would definitely expect the school to punish the other girl and I’ll request a meeting with the school and maybe speak to the police regarding whether it’s serious enough to press charges.

I will happily make such assumptions (and very, very likely be correct about them) over anybody who thinks that it is appropriate to sue their child’s school over such a trivial matter. OP using the word ‘nincompoop’ tells me all I need to know. Claim culture is alive and well.

What are you intending to sue the parents for ??

DD fell off the Monkey Bars at school, broke her arm in two places. So many people asked if I was going to sue the school, it was shocking. Erm, no .. it was an accident.

Depends if you ever want your child to be able to attend a sports day at her school again. If people start suing schools will stop running them.

YABU but I’m sorry this happened to your daughter.

I know how upsetting this is, I had a similar experience at school where my child suffered one of the worst fractures the doctor had ever seen. Required emergency surgery and was told to prepare for further surgical treatment/loss use of arm etc. This was because my child fell off a piece of equipment that was made unsafe due to weather conditions and it hadn’t been checked or cleaned.

How old are the girls? The age of criminal responsibility is 10 years in the England, Ireland and Wales. 12 in Scotland.

If the girl deliberately pushed your child, they could be arrested/cautioned for ABH.

I feel you're after money rather than justice. Suing can take a long time for no really gain. Especially when there are unlikely to be significant losses as a result.

It’s awful your daughter was injured, but you are being entirely ridiculous. The child who pushed her wouldn’t have done so intending actual harm, the school had no control over it at all. Nor did her parents.

I would expect the girl to apologise for pushing your daughter, and would think dimly of the parents for not making her do so.

There would be no legal action involved, however.

The other child shouldn’t have pushed but I don’t understand how suing the school will change anything? What do you hope the achieve with this?

What age are the children?
