To want my money that is owed on time

Long story short, I am owed payout money from a company that I stepped down from as a director recently. It is around £10K and was a staggered payment due to me after 6 months of leaving.

The time has now come and from what I have heard the company is struggling (although that is just hearsay) but still active. We had signed contracts etc but how long shall I give until I take things further if the money doesn't appear? What can I do if it doesn't get transferred shortly, get a solicitor involved?

I would be calling them as a first and asking when the money is being transferred as you were due it on X date!
could you go to CAB ?

Also record the conversation and follow up with an email ‘confirming’ the conversation

@T1Dmama yes, CAB might be a good place to start, thank you. Via a message they have said they'll get it sorted and come back to me asap, so fingers crossed. Is a week a suitable amount of time to give before seeking advice?

If the company might be struggling I would take action straight away.

@tothelefttotheleft yes, I agree I'd rather get it sorted sooner rather than later. They have said they'll come back to me asap, I should give them benefit of the doubt I guess for a few days at least?

Why are you asking on here rather than calling them and asking. How very odd.

Springwatch123 · 05/06/2024 12:07

Have you considered small claims court? If I recall, you gave to send them a registered letter of request with signature to prove they’ve received it.

Then if no reply, you submitted claim. It’s all done online and only goes to a live court at the final stages. You submit your claim and they respond. Any expenses occurred they pay ,if you win).

@Theweepywillow I was only asking for advice and opinions, like a lot of people do on MN for various reasons.

@Springwatch123 yes, that could be an idea then. I wasn't too sure on how it worked/how long you have to give etc but that could be the best way. And cheaper than a solicitor

Personally I would call CAB asap as they often don’t have appointments for a couple of weeks… better to have one and cancel it than wait and not be able to get one for even longer
